THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests, in effect, removal of a Memorandum for Record (MFR) from his official military personnel file (OMPF).  

2.  The applicant states an incomplete request for a driver's badge has been added to his OMPF and he would like it removed.  The document is dated 27 May 2014 and is signed by his commander; however, it is not showing an award.  His commander will be submitting the award of a driver's badge, but he doesn't want duplicate and/or incomplete paperwork in his OMPF.

3.  The applicant provides a copy of the MFR.

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the Regular Army on 24 March 2011 after completing prior U.S. Army Reserve service.  He was awarded military occupational specialty 42R (Band Member).

2.  His records contain and he provided a copy of an MFR, dated 27 May 2014, which stated he met the prerequisites for being awarded the Driver's Badge (Wheeled).  The memorandum shows the award was approved by his commander.

3.  Permanent Orders Number 254-07, dated 11 September 2014, awarded him the Driver and Mechanic Badge (Wheeled) for the period from 1 April 2013 through 8 April 2014.
4.  Army Regulation 600-8-22 (Military Awards) states commanders of brigades, regiments, separate battalions, and any commander in the rank of lieutenant colonel or higher may approve award of the Driver and Mechanic Badge.

5.  Army Regulation 600-8-104 (Army Military Human Resource Records) prescribes the policies governing the OMPF and it composition.  The regulation states once a document is placed in the OMPF it becomes a permanent part of that file and will not be removed from that file or moved to another part of the file unless directed by the proper authorities listed in the regulation.

6.  Military Personnel Message 13-024, Subject: Changes to Documents Authorized for Filing in the AMHRR and/or IPERMS), states effective immediately Army Personnel Records Division (APRD) will update the list of Authorized Documents for filing in the AMHRR quarterly.  The list provides for the filing on the performance folder of documents that award badges when no orders are published and orders announcing award of badges.  

DISCUSSION AND CONCLUSIONS:

An MFR was issued on 27 May 2014, which stated he met the prerequisites for the Driver's Badge.  Permanent orders awarded him the Driver and Mechanic Badge (Wheeled) on 11 September 2014.  By regulation, the orders awarding him the Driver's Badge supersede the MFR; therefore, it should be removed from the performance folder of his OMPF.

deleting/removing from the performance folder of his OMPF the MFR, dated 27 May 2014.
