THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:
1. The applicant requests removal of a Bachelor of Business Administration degree, two sets of transcripts, and verification of college degree completion, from Rochville University from her official military personnel file (OMPF).
2. The applicant states her OMPF contains a diploma, dated 20061218; transcripts, dated 20061218 and 20061227; and a verification letter, dated 2006. She wants them removed because the college is not accredited. In accordance with Army Regulation 600-8-104 (Army Military Human Resource Records Management) and the current publication of "Documents Required for Filing in iPERMS" (U.S. Army Human Resources Command/Army Soldier Records Branch, 21 May 2014), Civilian Institution Diplomas and Transcripts are to be filed only if from an accredited college.
3. The applicant provides the contested documents.
CONSIDERATION OF EVIDENCE:
1. Having prior enlisted service (Regular Army, February 1989 to February 1993), the applicant reenlisted in the U.S. Army Reserve (USAR) on 8 December 1996.
2. She holds military occupational specialty 42A (Human Resources Specialist). She served through multiple extensions or reenlistments and she was promoted to sergeant first class (SFC)/E-7 in October 2003.
4. Her OMPF contains:
a. Diploma, issued by Rochville University, on 18 December 2006, awarding her a Bachelor of Business Administration degree.
b. Two sets of college transcripts, undated, issued by Rochville University.
c. An undated letter from Rochville University verifying her successful completion of the Bachelor's Program from Rochville University.
5. An Internet search of Rochville University revealed it as an on-line university that describes itself as a fully accredited university, recognized by the Board of Online Universities Accreditation (BOUA) and the Universal Council for Online Education Accreditation (UCOEA). Both are among non-governmental accreditation agencies with members from all over the United States.
6. According to the official Department of Education website http://ope.ed.gov/
ACCREDITATION/Rochville University is not an accredited university.
7. On 15 April 2010, Military Personnel (MILPER) Message Number 10-109 announced the procedures for removal of fraudulent diplomas or transcripts from a Soldiers OMPF or Army Military Human Resource Records (AMHRR). It provided that Soldiers were required to submit their requests to have a transcript removed through their chain of command to the appropriate authority, which in this case is HRC.
8. A review of the applicant's official records failed to show any evidence that she submitted a request for removal of the transcript from her official records through her chain of command.
9. Army Regulation 600-8-104 governs the composition of the AMHRR and states the performance folder is used for filing performance, commendatory, and disciplinary data. Once placed in the OMPF, the document becomes a permanent part of that file. The document will not be removed from or moved to another part of the OMPF unless directed by certain agencies, to include this Board. Army Regulation 600-8-104 states college transcripts must be from an accredited college or university and are filed in the OMPF as verified by the Department of Education. Transcripts indicating degree completion are filed in the performance folder and incomplete transcripts are filed in the service folder.
DISCUSSION AND CONCLUSIONS:
Although the official Department of Education does not show Rochville University as an accredited university, the applicants official records do not contain any indication that she attempted to have the transcript removed using the procedures outlined in MILPER Message 10-109 and she has not sufficiently explained why she submitted the transcript for filing in her official records. Accordingly, it would not serve justice to remove the transcript from her records at this time.
