      The Board considered the following evidence:

      Exhibit A - Application for correction of military records.

      Exhibit B - Military Personnel Records (including advisory opinion,
if any).

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests that the second copy of his transcript from
Baylor University be removed from his Official Military Personnel File
(OMPF).

2.  The applicant states that his transcript from Baylor University is only
three pages long.  He states the second copy is a duplicate.

3.  The applicant provides two copies of his transcript from Baylor
University and one official transcript from Baylor University.

CONSIDERATION OF EVIDENCE:

1.  The applicant is currently serving on active duty in the rank of staff
sergeant.

2.  The applicant was awarded a Bachelor of Arts Degree in
Telecommunications on 19 December 1998.

3.  The applicant was issued an official transcript from Baylor University
in Waco, Texas on 17 March 1999.  This transcript was filed in the
applicant's performance section of his OMPF.

4.  The applicant was issued a second official transcript from Baylor
University on 20 August 1999 which shows his Bachelor of Arts Degree.  This
transcript was also filed in the applicant's performance section of his
OMPF.

5.  Army Regulation 600-8-104 (Military Personnel Information Management/
Records) sets forth the policies, operating tasks and steps for governing
the OMPF; the Military Personnel Records Jacket; the Career Management
Individual File; Army Personnel Qualification Records; and Military
Personnel Information Management as a work category.  Paragraph 2-4 of this
regulation states that once a document is placed in the OMPF it becomes a
permanent part of that file and will not be removed from that file or moved
to another part of the file unless directed by the ABCMR, the Department of
the Army Suitability Evaluation Board, Army Appeals Board, Chief of Appeals
and Corrections Branch of the Human Resources Command, the OMPF custodian
when documents have been improperly filed, Human Resources Command as an
exception, Chief of the Appeals Branch of the Army Reserve Personnel Center
and Chief of the Appeals Branch of the National Guard Personnel Center.

6.  Table 2-1 (Composition of the OMPF) of Army Regulation 600-8-104
provides that all transcripts of credit from civilian colleges,
universities, trade schools, or business schools are filed on the OMPF for
enlisted personnel.
DISCUSSION AND CONCLUSIONS:

1.  The applicant was awarded a Bachelor of Arts Degree from Baylor
University in December 1998.  He was issued an official transcript on 17
March 1999 and it was filed in his OPMF.

2.  The applicant was issued a second official transcript awarding him a
Bachelor of Arts Degree from Baylor University on 20 August 1999 and it was
also filed in his OMPF.

3.  Although the applicant's transcripts from Baylor University were issued
on different dates, they reflect the same degree.  Therefore, it would be
appropriate to remove the second transcript from Baylor University issued
on 20 August 1999 from the applicant's OMPF.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant
a recommendation for relief.  As a result, the Board recommends that all
Department of the Army records of the individual concerned be corrected by
removing the official transcript from Baylor University issued on 20 August
1999 from his OMPF.
