GENERAL: The applicant appeals for upgrade of discharge to Honorable.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contai ns available perti nent data on the appl icant and the factors leading to the discharge.

FINDING : The Board denies the upgrade of the discharge.

The Board finds the applicant submitted no issues contesting the equity or propriety of the discharge, and after a thorough review of the record, the Board was unable to identify any that would justify a change of discharge.

ISSUE: The applicant received a Genera l discharge for Misconduct - Drug Abuse

The Air Force Discharge Review Board, under its responsibi lity to examine the propriety and equity of an Applicant" s discharge, is authorized to change the characterization of service and the reason for discharge if such change is warranted. In reviewing discharges, the Board presumes regularity in the conduct of governmental affairs unless there is substantial credible evidence to rebut the presum pt ion, to include evidence submitted by the appl icant. The Board completed a thorough review of the circumstances that led to the discharge and the discharge process to ensure the discharge met the perti nent standards of equity and propriety. The applicant's record of service incl uded one Art icle 15 for usi ng Spice.

The applicant submitted no issues regard ing the ineq ui ty or impropriety of his discharge. The applicant cited his desire to recei ve the G.l. Bi ll benefits as justificat ion for upgrade. The DR B noted that when the applicant applied for these benefits , he signed a statement (DD Form 2366, on J u ne 19, 2009) that he understood be m ust recei ve an Honorable discharge to receive future educational ent itlemen ts. The Board was sympathetic to the impact from the loss of these benefits to the applicant; however, this is not a matter
of ineq ui ty or im propriety which would warrant an upgrade. A d ischarge is upgraded onl y if the applicant and the Board can establish that an ineq ui ty or im propriety took place at the time of d ischarge. A fter a thorough review of the record , the Board found no evidence to justify an upgrade of the discharge characterization.

CONCLUS I ON: The Discharge Review Board concludes that the discharge was consistent with the procedura l and substantive req uirements of the discharge regulation , was within the discretion of the d ischarge authori ty, and that the appl icant was provided full administrati ve due process.

In view of the foregoing find i ngs, the Boa rd further concludes tha t there exists no legal or equ itable basis for upgrade of discharge and determ ines the discharge should remai n unchanged.
