GENERA L: The applicant appeals for upgrade of discharge to honorable

The applicant appeared and testified before the Discharge Review Board (DRB), without counsel, via video teleconference between Andrews AFB Maryland and Travis AFB, CA on September 22 , 20 14.

FINDING: The Board denies the request for upgrade of discharge.

ISSUE: Applicant recei ved an Under Other Than Honorable Conditions discharge for misconduct - drug abuse and pattern of miscond uct.

The Air Force Discharge Review Board, under i ts responsibili ty to examine the propriety and equity of an Appl icant's discharge, is authorized to change the character of service and the reason for discharge if such change is warranted. In reviewi ng discharges, the Board presumes regularity in the conduct of governmental affairs unless there i s substantial credible evidence to rebut the presumption, to include evidence submitted by the appl icant. The Board did complete a thorough review of the circumstances that J ed to the discharge and the discharge process to ensure the discharge met the pertinent standards of equity and propriety. The applicant" s record of service included two A rt icle 15s, ten Letters of Repri mand and two Letters of Counsel. His miscond uct included; failure to meet training requi rements, fai lure to go to Com mander·s Call, speeding on base, provid ing alcohol to an underage person , damage to government property, failure of dorm room inspection , drunk and disorderl y conduct, and use of marijuana.

The applicant contends that he should not be penalized indefi ni tely for a mistake that he made when he was young. The DRB recogni zed the applicant was 22 years of age when the discharge took place. The Board opined the applicant was older than the vast majori ty of first-tenn members who properl y adhere to the Air Force's standards of cond uct. The Board opined that through the administrative actions taken, the applicant had ample opportuni ties to change his behavior. They found the seriousness of the willfu l miscond uct offset any positive aspects of the applicant's duty performance. The Board reviewed the entire record and found no evidence of improp1iety or ineq ui ty to warrant an upgrade of the discharge.

The DRB was pleased to see that the applicant was doing well and has a good job. However, no inequ i ty or impropriety in his discharge was suggested or found i n the cou rse of the heari ng. The Board concluded the misconduct of the applicant appropriatel y characterized his term of service.

A discharge is upgraded only if the applicant and the Board can establish that an inequity or impropriety took place at the time of discharge. After a thorough review of the record , the Board found no evidence to justify an upgrade of the discharge.

CONCLUSION : The Discharge Review Board concludes that the discharge was consistent wi th the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided ful l administrative due process.




In view of t he foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and detennines the discharge should remai n unchanged.
