APPLICANT REQUESTS THAT:
He be entitled to the Good Conduct Medal (GCM).

APPLICANT CONTENDS THAT:
He believes he should have been awarded the GCM and other awards
based on his Air Force service.
In support of his appeal, the applicant provides copies of his
DD Form 214, Certificate of Release or Discharge from Active
Duty, issued in conjunction with his 16 Nov 59 separation;
honorable discharge certificate from the United States Navy, and
a letter from his local veterans service organization.
The applicants complete submission, with attachments, is at
Exhibit A.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force, on 17 Nov 55,
for a period of four years. He was honorably discharged on
16 Nov 59 and credited with 4 years, 5 months, and 14 days of
total service.

AIR FORCE EVALUATION:
AFPC/DPSIDR recommends denial, stating, in part, based on review
of his records, they could not verify the applicant met or
exceeded the criteria for the award of the GCM.
In addition, they note the applicant received disciplinary
punishment during his first term of enlistment and as a result,
received a reduction in grade. No official documentation was
located that verifies the commander recommended the applicant
for award of the GCM. A detailed search of the applicant's
official personnel record did not find that he was entitled to
any other medal or award as a result of his military service.
In addition, no documentation was found which would indicate
that the Article 15 administered to the applicant had been
removed from his official military record.
The GCM is awarded to enlisted members who have honorably
completed three continuous years of active military service
subsequent to 26 August 1940, and who are recommended by their
commanding officers for exemplary behavior, efficiency ratings
of excellent or higher throughout the qualifying period,
including time spent in attendance at service schools, and there
must have been no convictions by court martial.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 28 Oct 11 for review and response. As of this
date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation
of the Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion the applicant has not
been the victim of an error or injustice. Therefore, in the
absence of evidence to the contrary, we find no basis to
recommend granting the relief sought in this application.

The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
