APPLICANT REQUESTS THAT:
1. He be awarded the Army of Occupation Medal with German Clasp
(AOM-G). (Administratively Corrected)
2. He be awarded the Euro-African-Middle Eastern Campaign Medal
(EAMECM); the Good Conduct Medal (GCM), and the Sharpshooter
Badge.

APPLICANT CONTENDS THAT:
These awards should have been reflected on his WD AGO Form 53,
Report of Separation, issued in conjunction with his 26 Nov 48
separation. When he separated, everything was fast and furious
and he was never asked about his service in Europe.
In support of his appeal, the applicant provides copies of his
separation documents and various other documents associated with
his request.

STATEMENT OF FACTS:
Based on the available records, the applicant enlisted in the
Army Air Corps, on 4 Feb 46 and was progressively promoted to
the grade of corporal (CPL).
The applicant is a former member of the Army Air Corps who
served in the European Theatre of Operation (ETO), as radio
mechanic. His WD AGO Form 53 reflects that he was awarded the
World War II Victory Medal (WWIIVM) and the AOM.
AFPC/DPSIDR will administratively correct the applicant’s AOM to
AOM-G.

THE AIR FORCE EVALUATION:
AFPC/DPSIDR recommends denial of the applicant’s request for
award of the EAMECM and the GCM. DPSIDR referred the applicant
to the United States Army in regard to his request for the
Sharpshooter Badge.
They were able to verify the applicant's entitlement to the AOM-
G and his record will be updated accordingly.
The GCM is awarded to enlisted members who have honorably
completed three continuous years of active military service
subsequent to 26 Aug 40, and who are recommended by their
commanding officers for exemplary behavior, efficiency, and
fidelity.
DPSIDR states the applicant served on active duty from 4 Feb 46
to 26 Nov 48 for a total of 2 years, 9 months, and 23 days,
rendering him ineligible for award of the GCM.
The EAMECM is awarded for service in the European-African-Middle
Eastern Theater between 7 Dec 41 and 8 Nov 45. The applicant
served in the ETO from 25 Dec 46 to 8 Nov 48, after the
inclusive dates for award of the EAMECM, rendering him
ineligible for the EAMECM.

APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 20 Mar 12 for review and response. As of this
date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice in respect to
the applicant’s entitlement to the award of the EAMECM. We took
notice of the applicant's complete submission in judging the
merits of the case; however, we agree with the opinion and

recommendation of the Air Force office of primary responsibility
and adopt its rationale as the basis for our conclusion that
relief beyond that which will be corrected administratively is
not warranted. Therefore, we find no basis to favorably
consider this portion of the application.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
