APPLICANT REQUESTS THAT:
1. His active duty time for his overseas deployment to Thurmait, Oman in
support of Operation ENDURING FREEDOM (OEF) from 1 Jun 02 through 29 Aug 02
be reflected on his DD Form 214, Certificate of Release or Discharge From
Active Duty.
2. His current Standard Form (SF) 50, Notification of Personnel Action, be
corrected.

APPLICANT CONTENDS THAT:
Having his overseas deployment reflected on his DD Form 214 would entitle
him to the Global War on Terrorism Expeditionary (GWOT-E) Medal and allow
him to utilize veteran’s preference for federal service employment.
The evidence submitted in support of the appeal is at Exhibit A.

STATEMENT OF FACTS:
The DD Form 214, Certificate of Release or Discharge from Active Duty,
submitted by the applicant reflects he served on active duty from 11 Jan 99
to 7 Mar 05.
The remaining relevant facts pertaining to this application are contained
in the letter prepared by the appropriate office of the Air Force, which
are attached at Exhibits C.

AIR FORCE EVALUATION:
HQ ARPC/DPSVT reviewed this application and recommends denial since there
is no source documentation available to substantiate his request.
A complete copy of the evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 12 Nov 10
for review and comment within 30 days. As of this date, no response has
been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error or an injustice. After reviewing the available
documentation we believe the Special Order provided by the applicant is
sufficient to support that he served in an area of eligibility in direct
support of OEF and is therefore eligible for the GWOT-E. Therefore, we
recommend his records be corrected to the extent indicated below.
4. In regard to the applicant’s request concerning the correction of his
SF 50. We note this type of action does not fall under the purview of the
Board since the Board’s authority is limited to the correction of an Air
Force military record. Therefore, we suggest he contact his civilian
personnel office.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that he is entitled to the Gulf War on
Terrorism Expeditionary (GWOT-E) Medal.
