APPLICANT REQUESTS THAT:
The Gallant Unit Citation (GUC), Meritorious Unit Award (MUA), Air Force
Outstanding Unit Award (AFOUA), Afghanistan Campaign Medal (ACM), Iraq
Campaign Medal (ICM), and the Global War on Terrorism Expeditionary
Medal (GWOT-E) be added to his DD Form 214, Certification of Release or
Discharge From Active Duty.

APPLICANT CONTENDS THAT:
He is eligible for medals for his service in support of Operation’s
ENDURING FREEDOM and IRAQI FREEDOM.
In support of his request, applicant submitted copies of his DD Form
214, Air Medal citations, and a list of his units of assignment.
Applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
Applicant served on active duty in the Regular Air Force from 18 Mar
98 to 17 Jun 04. He was honorably discharged with a total of six years
and three months of active military service. His DD Form 214 indicates
he served three years, four months and two days of Foreign Service, and
that he was awarded the Aerial Achievement Medal, with two devices, Air
Medal, Air Force Achievement Medal, with one device, Air Force Training
Ribbon, Armed Forces Expeditionary Medal, Combat Readiness Medal, Air
Force Longevity Service Award, NCO Professional Military Education
Ribbon, National Defense Service Medal, Air Force Outstanding Unit
Award, with Valor, with four devices, and Air Force Good Conduct Medal,
with one device.
On 27 Jul 04, ARPC administratively corrected the applicant’s DD
Form 214 to reflect the Air Force Expeditionary Service Ribbon, with
Gold Border.
On 25 Apr 06, AFPC determined the applicant was eligible for the MUA,
AFOUA, and the GWOT-E and forwarded the awards to him. They also stated
that his records would be corrected to add these awards to his DD Form
214.

AIR FORCE EVALUATION:
HQ ARPC/DPPPR recommends denial of the applicant’s request to add the
ACM, ICM and GUC to his DD Form 214. After a through review of
applicant’s military record they were unable to locate source
documentation to determine the quantity of days, nor the area of
eligibility, to substantiate the requirements for the ACM or the ICM.
Also, applicant’s units of assignment were not awarded the GUA.
The ACM may be awarded to members of the Uniformed Services of the
United States who serve or who have served in Afghanistan (or its
contiguous air space) in support of OEF from 24 Oct 01 to a date to be
announced. To be eligible for the ACM, a service member must be
assigned or attached to a unit participating in OEF for 30 consecutive
days or for 60 nonconsecutive days in Afghanistan.
The ICM is to recognize servicemembers who serve or who have served in
the country of Iraq and the contiguous water area out to 12 nautical
miles, and all air spaces above the land area of Iraq and above the
contiguous water area out to 12 nautical miles of Iraq. Eligibility for
the ICM requires servicemembers to have served in direct support of
Operation IRAQI FREEDOM. The period of eligibility is on or after 19
Mar 03 to a future date to be determined by the Secretary of Defense or
the cessation of OIF. Servicemembers must have been assigned, attached,
or mobilized to units operating in the area of eligibility for 30
consecutive days or for 60 nonconsecutive days. Under most
circumstances, no personnel or unit should receive the ICM, the GWOT-E,
the Global War on Terrorism Service Medal (GWOT-S), the ACM, or the
Armed Forces Expeditionary Medal (AFEM) for the same deployment, action,
or period or service; however, should an individual be forward-deployed
from a primary deployment location, the individual must provide source
documentation (i.e., performance report, decoration, letter of
evaluation, travel voucher, etc.) to substantiate deployment locations
and minimum deployment days were indeed met and confirmed by home
deployment location and the individual. Entitlement to ICM does not
disqualify entitlement to other DoD service or Air Force achievement
awards.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 21 Jul 06, a copy of the Air Force evaluation was forwarded to the
applicant for review and comment within 30 days. As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion
that the applicant has not been the victim of an error or injustice. As
stated, by the office of primary responsibility, the applicant’s
eligibility for the MUA, AFOUA, and GWOT-E have been verified and his
records will be corrected administratively. However, after thoroughly
reviewing the applicant’s records, and documentation he provided, we do
not find any evidence that indicates he met the criteria for award of
the GUC, ACM, and ICM. Therefore, in the absence of evidence to the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
