APPLICANT REQUESTS THAT:

His records be corrected to show he served in the Republic of Vietnam.

APPLICANT CONTENDS THAT:

He aided in emergency re-supply  efforts  during  “Operation  Junction
City” in the Republic of Vietnam and his records do not indicate  this
service.  He attempted to apply for benefits  and  realized  that  his
Vietnam service was not reflected in his records.

In support of his request, the applicant submits a History of the 50th
Tactical Airlift Squadron, a copy of his DD Form 214, Armed Forces  of
the United States Report of Transfer or  Discharge,  and  Aeronautical
Order number 105.

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air Force on 27 Apr  65,  for  a
term of four years and was progressively  promoted  to  the  grade  of
staff sergeant.  On 23 Mar 69, he was  discharged  with  an  honorable
discharge characterization for expiration  of  term  of  service.   He
served a total of 3 years, 10 months and 27 days active duty service.

His record reflects award of the National Defense Service Medal and  1
year and 24 days Foreign Service.

AIR FORCE EVALUATION:

AFPC/DPAPP recommends denial and states there is no documentation that
proves he served in Vietnam.

On 12 Oct 07, DPAPP requested the applicant provide  documentation  to
support his claim.  He was informed that his records did  not  confirm
any temporary duty (TDY) assignments or flights into Vietnam.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 7
Dec 07, for review and comment within 30 days.  As of  this  date,  no
response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice.  After a thorough review  of  the
applicant’s submission and the available evidence of record, the Board
was not persuaded that he should be granted the requested relief.  The
Board notes no evidence was presented to show the  applicant  actually
served in or flew missions into Vietnam.  In view of  this,  we  agree
with the opinions and recommendations  of  the  Air  Force  office  of
primary responsibility and adopt its rationale as the  basis  for  our
conclusion that the applicant has not been the victim of an  error  or
injustice.  Therefore, in the absence of evidence to the contrary,  we
find no compelling basis to recommend granting the  relief  sought  in
this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of a material error or injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
