APPLICANT REQUESTS THAT:
He be awarded the Armed Forces Expeditionary Medal (AFEM).

APPLICANT CONTENDS THAT:
He was stationed in Nakhon Phanom, Thailand during and in support of the
war efforts in Vietnam. His service should be recognized.
In support of his request, applicant provides a copy of his DD Form 214 and
copies of his record of medical care. The applicant’s complete submission,
with attachments, is at Exhibit A.

STATEMENT OF FACTS:
On 10 Jun 71, the applicant enlisted in the Regular Air Force. The
applicant was progressively promoted to the rank of sergeant (E-4) having
assumed that grade effective and with a date of rank of 4 May 73.
The applicant was honorably discharged on 12 Jun 75. He was credited with
4 years of active duty service, of which 1 year, 7 months and 20 days was
foreign service. His discharge document reflects he was awarded the
National Defense Service Medal.
On 15 Jul 74, the applicant was denied the Air Force Good Conduct Medal.
The applicant was placed on the Control Roster for his substandard
performance of duty during the period of 15 Jan 74 to 15 Apr 74.

AIR FORCE EVALUATION:
AFPC/DPSIDR recommends denial. DPSIDR states that “in accordance with DoD
1348.33, Chapter 6, Para C6.5.1.5 Limitations on Awarding Medals, the
military service of the service member on which qualification for the award
of the AFEM is based shall have been honorable.” The applicant was placed
on the Control Roster
for his substandard performance of duty during the period of his TDY. The

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 21 Dec
07 for review and comment within 30 days. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant’s
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or an injustice.
Therefore, in the absence of evidence to the contrary, we find no
compelling basis to recommend granting the relief sought in this
application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
