APPLICANT REQUESTS THAT:

His record be corrected to reflect  award  of  the  Presidential  Unit
Citation (PUC), the Republic of  Vietnam  Gallantry  Cross  with  Palm
(RVNGC w/P), and the Republic of Vietnam Campaign Medal (RVNCM).

APPLICANT CONTENDS THAT:

The requested awards are missing from  his  DD  Form  214,  Report  of
Transfer or Discharge.

STATEMENT OF FACTS:

Applicant was assigned to the 366th  Combat  Support  Squadron  (CSS),
DaNang Air Base, Vietnam, from 5 September 1966 to  1 September  1967.
He was awarded the Air Force Commendation Medal  (AFCM),  the  Vietnam
Service Medal (VSM), and the RVNCM for his tour in Vietnam.

AIR FORCE EVALUATION:

AFPC/DPPPR states they were able to  verify  his  entitlement  to  the
RVNGC w/P and the RVNCM from his Report of  Separation  dated  7 March
1969.  Additionally, DPPPR verified his entitlement to the  Air  Force
Outstanding Unit Award with Valor and one  Oak  Leaf  Cluster.   DPPPR
notes the Retirements and Separations Office will update his  DD  Form
214 to include the awards listed.  Regarding  the  award  of  the  PUC
however, DPPPR was not able to verify that his assigned unit  received
the PUC during the period he was serving in Vietnam.  DPPPR  therefore
recommends his request for award of the PUC be denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  on
27 July 2007 for review and comment within 30 days.  As of this  date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was not  timely  filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the existence of error or  injustice  to  warrant  correction  of  his
records  to  reflect  award  of  the  PUC.   We  took  notice  of  the
applicant's complete submission in judging the  merits  of  the  case;
however, noting the administrative corrections previously made to  his
records, we agree with the Air Force office of primary  responsibility
that absent evidence he was assigned to a  unit  authorized  the  PUC,
favorable  consideration  of  that  portion  of  his  request  is  not
warranted.  Therefore, we adopt the rationale expressed as  the  basis
for our conclusion that the applicant has not been the  victim  of  an
error or injustice.  In the absence of evidence to  the  contrary,  we
find no compelling basis to recommend granting the  relief  sought  in
this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
