APPLICANT REQUESTS THAT:
He be awarded the Air Force Good Conduct Medal (AFGCM), Air Force
Outstanding Unit Award with Valor (AFOUA w/V), Vietnam Service Medal with
One Silver Bronze Star and Three Bronze Service Stars (VSM w/1SS and 3BSS),
Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P), and the Republic
of Vietnam Campaign Medal (RVNCM).

THE APPLICANT CONTENDS THAT:
His separation document is not accurate because his service was not
properly documented in his official records.
In support of his request, applicant provides a copy of his DD Form 214 and
other various documents from his personnel record. Applicant’s submission,
with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force in the grade of airman
basic (E-1) on 17 August 1965. He served as a security policeman and was
progressively promoted to the grade of sergeant (E-4) effective 1 October
1968. Applicant’s records reflect Vietnam service from 15 March 1968 to 29
August 1968.
On 15 January 1969, he was honorably released from active duty, having
served 3 years, 4 months and 29 days of active duty service of which 5
months and 17 days were foreign service. After having been released from
active duty, he was transferred to the Air Force Reserve for completion of
his military service obligation, which occurred on 16 August 1971.
On 31 August 2006, during a records review, Headquarters Air Force
Personnel Center issued the applicant a DD Form 215, reflecting the AFGCM,
VSM w/ 3BSS.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends a partial grant. DPPPR advises that they were able
to verify the applicant’s entitlement to the AFGCM for serving three years
of honorable service and the VSM w/3BSS while serving in Vietnam. However,
DPPPR was unable to verify his unit received the AFOUA w/V, RVNGC w/P and
any other additional awards during the time period the applicant served.
The applicant did not serve in Vietnam for six months to be eligible for
award of the RVNCM. The AFPC/DPPPR evaluation is at Exhibit C.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was sent to the applicant on 8 September
2006 for review and comment within 30 days. As of this date, this office
has not received a response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. The applicant’s contentions are duly
noted, however, after a careful review of the evidence of record, we find
his assertions, in and by themselves, insufficient to support findings that
he was entitled to the Air Force Outstanding Unit Award with Valor, Vietnam
Service Medal with one Silver Bronze Star, Republic of Vietnam Gallantry
Cross with Palm and the Republic of Vietnam Campaign Medal. Therefore, we
agree with the opinion and recommendation of the Air Force office and adopt
its rationale as the basis for our conclusion that the applicant has failed
to sustain his burden that he has suffered either an error or injustice in
this matter. Accordingly, there is no basis on which to favorably consider
his request. The applicant's request for the Good Conduct Medal and the
Vietnam Service Medal with three Bronze Service Stars were administratively
corrected and therefore not considered by this board.
4. The applicant's case is adequately documented and it has not been shown
that a personal appearance with or without counsel will materially add to
our understanding of the issues involved. Therefore, the request for a
hearing is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the application
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.
