APPLICANT REQUESTS THAT:
He be awarded the Republic of Vietnam Campaign Medal (RVCM), Southwest Asia
Service Medal (SWASM), Air Force Overseas Ribbon-Long Tour (AFOSR-L),
American Defense Service Medal (ADSM), Asiatic-Pacific Campaign Medal
(APCM), Presidential Unit Citation, Air Force Outstanding Unit Award
(AFOUA), Armed Forces Expedition Medal (AFEM), Air Force Good Conduct Medal
(AFGCM), the National Defense Service Medal (NDSM), Air Force Longevity
Service Award (AFLSA) and any other missing awards.
Examiner’s Note: AFPC/DPPPR verified the applicant’s entitlement to the
AFOUA with Valor, the VSM, and the RVNGC with Palm. The applicant’s DD
Form 214, Certificate of Release or Discharge from Active Duty, reflects
award of the AFGCM, NDSM, and the AFLSA. The RVNGC with Palm is an award
of a foreign government and is not stocked or issued by the Air Force.
Therefore, the only issues before the Board are the PUC, ADSM, SWASM, AFEM,
APCM, AFOSR-L and the RVNCM.

APPLICANT CONTENDS THAT:
His DD Form 214 was issued without the requested ribbons, awards, and
campaign medals.

STATEMENT OF FACTS:
On 6 October 1971, the applicant enlisted in the Regular Air Force.
The applicant’s DD Form 214 reflects he received the following decorations
and medals: National Defense Service Medal (NDSM), Air Force Good Conduct
Medal (AFGCM), and the Air Force Longevity Service Award (AFLSA) Ribbon.
On 7 October 1975, the applicant was honorably discharged in the grade of
sergeant under the provisions AFR 39-10, Expiration Term of Active
Obligated Service. He served four years of total active duty service.

AIR FORCE EVALUATION:
AFPC/DPPPR recommended denial indicating they thoroughly reviewed the
applicant’s official military record and were able to verify his
entitlements to the AFOUA with Valor, the VSM, and the RVNGC w/P earned for
the period of 26 November 1973 to 17 August 1974 for his assignment in
Thailand.
The PUC is conferred on units of the armed forces of the United States and
of cobelligerent nations, for extraordinary heroism in action against an
armed enemy on or after 7 December 1941. The applicant’s unit of
assignment was not awarded this ribbon.
The AFGCM, NDSM, and the AFLSA are listed on the applicant’s DD Form 214.
The AFEM is awarded to members of the United States Armed Forces who, after
1 July 1958, have participated in a United States military operation and
encountered foreign armed opposition, or were in danger of hostile action
by foreign Armed Forces. The applicant has the VSM for Thailand and cannot
be awarded the AFEM for the same timeframe.
The SWASM and the AFOSR-L were established and awarded after the
applicant’s enlistment ended. The ADSM and the APCM were established
during World War II, prior to the applicant’s enlistment.
The RVNCM is a foreign award awarded to members of the Armed Forces of the
United States who: 1) Served for six months in South Vietnam during the
period 1 March 1961 and 28 March 1973. The applicant was there 26 November
1973 to 17 August 1974 outside the inclusive period for this award.
The RVNGC w/P is an award of a foreign government and is not stocked or
issued by the United States Air Force. It may be obtained from a
commercial source. The following does not necessarily constitute Air Force
sanction of these firms: Medals of America, Nash’s Ribbons, and Military
Medals and Displays.
The applicant’s DD Form 214 will be updated to reflect the newly awarded
medals listed above.
The applicant is not entitled to the PUC, the ADSM, the SWASM, the AFEM,
the APCM, the AFOSR-L and the RVNCM for the aforementioned reasons.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 26 August 2005, a copy of the Air Force evaluation was forwarded to the
applicant for review and response within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force and adopt its
rationale as the basis for our conclusion that the applicant has not been
the victim of an error or an injustice. It is noted the applicant’s
records reflect he was awarded the AFGCM, the NDSM and the AFLSA;
therefore, this portion of the applicant’s request is moot. In addition,
AFPC/DPPPR verified his entitlement to the AFOUA with Valor, the VSM, and
the RVNGC with Palm. In regards to the RVNGC with Palm, this award is not
stocked or issued by the Air Force. It may be obtained from a commercial
source (i.e., Medals of America, Nash’s Ribbons, or the Military Medals and
Displays). With respect to the issues of the PUC, ADSM, SWASM, AFEM, APCM,
AFOSR-L, and the RVNCM, the Board finds no supporting documentation in the
applicant’s record to indicate he was recommended for these awards;
therefore, his entitlement to the awards cannot be verified. In regards to
the AFEM, it is awarded to members who, after 1 July 1958 had participated
in a United States military operation and encountered foreign armed
opposition, or were in danger of hostile action by foreign Armed Forces.
The applicant received the VSM for operation in Thailand, therefore, he
cannot be awarded the AFEM for the same time frame. In view of the above
and in the absence of evidence to the contrary, we find no compelling basis
to recommend granting the relief sought.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not demonstrate the
existence of an error or injustice; the application was denied without a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered with this
application.
