APPLICANT REQUESTS THAT:

His DD Form 214, Armed Forces of the United States Report of  Transfer
or Discharge and NA Form 13059, Transmittal of and/or  entitlement  to
Awards be corrected to show  he  was  awarded  the  Presidential  Unit
Citation (PUC) and the Air Force Commendation Medal (AFCM).

APPLICANT CONTENDS THAT:

He should be authorized the awards.

In support of his request,  the  applicant  provided  a  copy  of  the
citation to accompany the award of his AFCM and a personal letter.

His complete submission is at Exhibit A.

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air Force on 3 February 1964.

He was discharged with an honorable discharge on 17 July 1967.  He had
3 years, 5 months and 15 days of total active service.

AFPC was able to verify the applicant’s entitlement to the Small  Arms
Expert Marksmanship Ribbon and the Republic of Vietnam Gallantry Cross
with Palm (RVNGC) and will update his official records to reflect  the
awards.
The PUC is conferred on units of the armed forces of the United States
and of cobelligerent nations,  for  extraordinary  heroism  in  action
against an armed enemy on or after 7  December  1941.  The  unit  must
display  such  gallantry,  determination,  and  esprit  de  corps   in
accomplishing its mission as to set it  apart  from  and  above  other
units participating in  the  same  campaign.  The  degree  of  heroism
required  is  the  same  that  which  would  warrant  award   of   the
Distinguished Service Cross to an individual. An  individual  assigned
or permanently attached to, and also present for duty with, a unit  in
the action for which the Presidential Unit  Citation  is  awarded  may
wear the emblem as a permanent part of their uniform.
The AFCM was authorized by the Secretary of the Air Force on March 28,
1958, for award to members of the Armed Forces of  the  United  States
who, while serving in any capacity with the Air Force after March  24,
1958, shall have distinguished themselves by  meritorious  achievement
and service. The degree of merit must be distinctive, though  it  need
not be unique. Acts of courage which do not involve the voluntary risk
of life required for the Soldier's Medal (or the  Airman's  Medal  now
authorized for the Air Force) may be considered for the AFCM.

AIR FORCE EVALUATION:

AFPC/DPPPR  recommends  denial.   DPPPR  states  the  AFCM   must   be
accompanied with an order awarding the applicant the award.  They were
not able to verify if any of the units he was assigned to received the
PUC during the time he was assigned there;  therefore  they  recommend
disapproval for the applicants request for award of the AFCM  and  the
PUC.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Applicant provided a copy of Special order number G-765, dated  30 May
1967 awarding the AFCM.  The applicant believes he should  be  awarded
two devices on the RVNGC w/P. In  addition,  the  applicant  requested
records from the 5th Special Forces be checked to see if the dates  he
served with them were awarded the PUC.

His complete submission is at Exhibit D.

Examiners Note:  In response to the DPPPR evaluation.   The  applicant
requested three devices on the RVNGC w/P;  however,  devices  are  not
authorized on the RVNGC  w/p.   DPPPR  also  checked  the  applicant’s
record and did not locate any PUC awards for the applicant’s  unit  of
assignment.  In addition, AFPC will correct applicant’s DD Form 214 to
show he was awarded the AFCM.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice.  After a thorough review  of  the
available evidence and the applicant’s complete submission, the  Board
is not persuaded that his records should be corrected to show  he  was
awarded the PUC.  Should he secure supporting documentation, we  would
be  willing  to  reconsider  his  application.    Therefore,   without
persuasive evidence we find no compelling basis to  warrant  favorable
consideration of his application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate  the  existence  of  material  error  or  injustice;   the
application  was  denied  without  a  personal  appearance;  and   the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
