APPLICANT REQUESTS THAT:
His records be corrected to reflect he was awarded the Presidential
Unit Citation (PUC) and the Republic of Vietnam Campaign Medal
(RVNCM).

APPLICANT CONTENDS THAT:
He served in Vietnam and should be awarded these medals.
In support of his request, the applicant provided a letter and
performance reports for the period ending 18 January 1967 and 25 March
1967.
Applicant's complete submission, with attachments, is attached at
Exhibit A.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force (RegAF) on 4 October
1963, as an airman basic (AB) for a period of four years.
The applicant’s records reflect he was awarded the Air Force Longevity
Service Award (AFLSA), the National Defense Service Medal (NDSM) and
the Air Force Good Conduct Medal (AFGCM).
The applicant’s performance report for the period 19 January 1967
through 25 March 1967 reflects he was assigned to the 616th Military
Airlift Support Squadron (MASS), Tan Son Nhut AF, RVN.
The applicant was honorably released from the AF on 3 October 1967 in
the grade of sergeant (SGT). He served four years of active duty
service.
On 8 June 2006, HQ AFPC/DPPRSP informed the applicant his eligibility
for the Air Force Outstanding Unit Award (AFOUA), Vietnam Service
Medal with two Bronze Service Stars (VSM w/2 BSS), Republic of Vietnam
Gallantry Cross with Palm (RVNGC w/P) and the Sharpshooter Badge had
been verified and his records will be corrected administratively to
add the aforementioned medals.

AIR FORCE EVALUATION:
HQ AFPC/DPPPR recommends the requested relief be denied. HQ
AFPC/DPPPR was unable to verify the 616th MASS received the PUC during
the applicant’s service period from 19 January to 25 March 1967.
HQ AFPC/DPPPR further states the RVNCM is awarded to: 1)
Servicemembers for six months in South Vietnam during the period 1
March 1961 and 28 March 1973; 2) Served outside the geographical
limits of South Vietnam and contributed direct combat support to the
RVN Armed Forces for an aggregate of six months. The applicant is not
eligible for the RVNCM due to not meeting the minimum in-country time
requirement.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
16 June 2006, for review and response. As of this date, no response
has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and the recommendation of the Air
Force and adopt its rationale as the basis for our conclusion that the
applicant has not been the victim of an error or an injustice. The
applicant requests he be awarded the PUC and RVNCM. HQ AFPC/DPPPRA
has advised they have verified the applicant is entitled to the AFOUA,
VSM w/2BSS, RVNGC w/P and the Sharpshooter Badge and his record has
been corrected administratively. There is no official documentation
in the applicant’s records to substantiate his unit received the PUC
during his service from 19 January to 25 March 1967. Upon a thorough
review of the applicant’s records it has been determined he is
ineligible for the RVNCM due to not meeting the minimum in-country
time requirements. Therefore, in the absence of evidence to the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

DPPPR further states the 377th TCS did not receive the RVNGC w/P during the time the applicant served in Vietnam. He requests recheck be done regarding the unit number (Exhibit E). In this respect, the Board notes that during his service in Vietnam the applicant was not assigned to a unit that received the Republic of Vietnam Gallantry Cross with Palm.

Note: Applicant’s records have been corrected to reflect the award of the VSM and the Air Force Outstanding Unit Award. Further, DPPPR was unable to verify that his unit received any additional bronze stars during the time he was assigned to the unit. The RVNCM is only awarded to those military members who served in Vietnam for six months; which he did not.
