APPLICANT REQUESTS THAT:
His DD Form 214, Armed Forces of the United States Report of Transfer or
Discharge, be corrected to reflect his award of the Presidential Unit
Citation (PUC), Air Force Outstanding Unit Award with Valor (AFOUA w/V),
and Republic of Vietnam Gallantry Cross with Palm (RVNGC w/P).

APPLICANT CONTENDS THAT:
These awards were overlooked at the time of his discharge as he feels he is
entitled to them.
In support of his application, the applicant provides copies of a condensed
version of his squadron’s history and his request for military records.
The applicant’s submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
On 13 February 1968, the applicant enlisted in the Regular Air Force at the
age of 19 in the grade of airman basic (E-1) for a period of four years.
The applicant was progressively promoted to the rank of staff sergeant (E-
5) with a date of rank of 1 March 1971. He performed duties as an Aircraft
Maintenance Specialist. On 11 February 1972, he was released from active
duty and transferred to the Air Force Reserve. He served 3 years, 11
months, and 29 days of active duty of which 1 year, 2 months, and 6 days
was foreign service. His DD Form 214 reflects his decorations as the
National Defense Service Medal, Vietnam Service Medal with one Bronze
Service Star, and the Republic of Vietnam Campaign Medal.
On 28 August 2006, the Air Force Personnel Center Separations Branch issued
a DD Form 215, Correction to DD Form 214, adding the Air Force Outstanding
Unit Award with Valor and one Oak Leaf Cluster, Air Force Good Conduct
Medal, and the Republic of Vietnam Gallantry Cross with Palm to the
applicant’s records.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends denial of the applicant’s request for the award of
the PUC. DPPPR states the applicant’s unit did receive the PUC during the
period 1 November 1968 to 31 October 1969; however, the applicant did not
arrive to Thailand until 14 November 1969; therefore, he is not entitled to
the PUC. DPPPR was able to verify the applicant’s entitlement to the AFOUA
w/V plus one Oak Leaf Cluster, the AFGCM and the RVNGC w/P.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 8
September 2006, for review and comment within 30 days. As of this date,
this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. We note the Air Force has corrected
the applicant’s record to reflect his award of the AFOUA w/V and RVNGC w/P;
therefore, we will only address the applicant’s request for award of the
PUC. After a thorough review of the available records, we found no
evidence that the applicant is eligible for award of the PUC. While we
note the applicant’s assertion that he is entitled to award of the PUC,
evidence of record indicates he was not assigned to his unit during the
period they were awarded the PUC. Therefore, we agree with the opinion
from the Air Force office of primary responsibility that the applicant is
not a victim of error or injustice in regard to award of the PUC. In view
of the above, we find no basis to favorably consider his request for the
PUC.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

_________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPPPR states they were able to verify his entitlement to the RVNGC w/P and the RVNCM from his Report of Separation dated 7 March 1969. Regarding the award of the PUC however, DPPPR was not able to verify that his assigned unit received the PUC during the period he was serving in Vietnam. DPPPR therefore recommends his request for award of the PUC be denied.
