APPLICANT REQUESTS THAT:

He be given credit for his service in Vietnam.

APPLICANT CONTENDS THAT:

He served in Vietnam from April 1965 to April 1966.

In support of his request, the applicant provided a  copy  of  his  DD  Form
214, Armed Forces of the United States Report of Transfer or Discharge.

Applicant’s complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

Applicant entered active duty  on  16  September  1963.   He  served  as  an
Apprentice Administrative Specialist.  On  5  June  1967  he  was  honorably
released with 3 years, 8 months, and 19 days on active duty.

On 6 April 2007, AFPC/DPAPP notified the applicant that they  did  not  find
any documents in his  records  to  show  he  was  in  Vietnam.   Records  do
indicate that he was in the  Philippines.   DPAPP  asked  the  applicant  to
search his personal records to find and provide documents to verify  he  was
in Vietnam, i.e., flight records, PCS/TDY orders  or  travel  vouchers  that
specifically show the time and location where he was  in  Vietnam.   He  did
not respond.

AIR FORCE EVALUATION:

AFPC/DPAPP recommends denial.  DPAPP states there are no  documents  in  the
applicant’s record that show he was ever assigned or TDY  to  Vietnam.   His
record does show that he was assigned to the Philippines from 16  June  1966
to 16 June 1967.  In  addition,  none  of  his  Airman  Performance  Reports
(APRs) have any remarks stating that he  was  assigned  or  TDY  to  Vietnam
during his tour of duty overseas.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 8 June 2007, the evaluation was forwarded to  the  applicant  for  review
and comment within 30 days (Exhibit D).  As of this date,  this  office  has
received no response.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing  law  or
regulations.

2.    The application was not timely filed; however, it is in  the  interest
of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to  demonstrate  the
existence of an error or injustice.  The applicant’s  contentions  are  duly
noted; however, after reviewing the evidence of record  we  agree  with  the
opinion and recommendation of the Air Force and adopt its rationale  as  the
basis for our conclusion that the applicant has not been the  victim  of  an
error or injustice.  There are no  documents  in  the  applicant’s  military
personnel record which reflect he served  in  Vietnam  (i.e.,  stationed  or
sent TDY to Vietnam during his tour of duty in the  Air  Force).   Moreover,
he has not submitted any documentation to  support  his  assertion  that  he
served in Vietnam.  Therefore, in the absence of evidence to  the  contrary,
we find no compelling basis to recommend granting the relief sought.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented  did  not  demonstrate  the
existence of an error or injustice; the application  was  denied  without  a
personal appearance; and the application will only be reconsidered upon  the
submission of newly discovered relevant evidence not  considered  with  this
application.
