APPLICANT REQUESTS THAT:

He be given credit for TDY's to Vietnam during 1973 and 1974.

THE APPLICANT CONTENDS THAT:

While stationed at Clark  AFB,  PI,  he  went  TDY  to  Vietnam  on  several
occasions.  He does not have records to show his service in Vietnam.   Until
now, he never noticed his trips to Vietnam were  not  reflected  on  his  DD
Form 214.

In support of his request, applicant provides copies of his DD  Form  214's,
retirement order and a copy of an evaluation report for the period 13  March
1973 to 12 March 1974.  Applicant’s complete submission,  with  attachments,
is at Exhibit A.

STATEMENT OF FACTS:

On 30 June 1975, the  applicant  was  relieved  from  active  duty  and  was
retired in the grade of master sergeant effective  1 July  1975.   Applicant
was credited with 22 years and 21 days of total service for  basic  pay  and
20 years, 1 month and 15 days of active service for retirement.

His discharge document for the period in question reflects  he  was  awarded
the Air Force Good Conduct Medal and the Air Force Longevity Service  Award,
Fourth Oak Leaf Cluster.

AIR FORCE EVALUATION:

AFPC/DPAPP recommends denial.  DPAPP advises there are no documents  in  the
applicant's personnel record to verify any TDYs to  Vietnam.   In  addition,
the applicant's commander was unable to verify any TDYs to Vietnam  made  by
the applicant.   The AFPC/DPAPP evaluation is at Exhibit B.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was sent  to  the  applicant  on  16 June
2006 for review and comment within 30 days.  As of this  date,  this  office
has not received a response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or
regulations.

2.  The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of an error or injustice.  The applicant’s  contentions  are  duly
noted; however, after reviewing the evidence of record  we  agree  with  the
opinion and recommendation of the Air Force and adopt its rationale  as  the
basis for our conclusion that the applicant has not been the  victim  of  an
error or injustice.  We note there  are  no  documents  in  the  applicant’s
military personnel record which reflect he served in Vietnam (i.e.,  TDY  to
Vietnam during his tour of  duty  in  the  Air  Force).   Therefore,  absent
documentation to sustain his contention that he  served  in  Vietnam  during
the period in question, we find no basis to recommend  granting  the  relief
sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of probable material error or injustice; that the  application
was denied without a personal appearance;  and  that  the  application  will
only be reconsidered  upon  the  submission  of  newly  discovered  relevant
evidence not considered with this application.
