APPLICANT REQUESTS THAT:

His Officer Selection Brief (OSB) considered by the  Calendar  Year
2005A (CY05A) Lieutenant Colonel Central Selection Board  (CSB)  be
corrected  to  show  the  addition  of  his  duty  title  effective
28 February 2005, as “Air Force Advisory Branch, Office of Military
Cooperation,” and to reflect his overseas deployments in  his  duty
history.

He be considered for promotion to the grade of  lieutenant  colonel
by Special Selection Board (SSB) with the corrected record.

APPLICANT CONTENDS THAT:

His records met the Lt Col selection  board  with  incorrect  data,
which he  was  not  given  a  fair  opportunity  to  verify.   This
significantly  contributed  to  his  non-selection  to   lieutenant
colonel.  He was assigned in Kuwait from February 2004  –  February
2005.  During his tenure there, he received no information  on  his
Lt Col selection board and did not receive an Officer Pre-Selection
Brief (OPB).  When he returned from active duty, he was informed he
would meet the next Lt Col Board after one year of active duty.  He
provided a draft Promotion Recommendation Form (PRF) in case it was
needed.  He met the P0505A Board without the opportunity to correct
any information on his OPB, as he was not forwarded one and was not
completely sure which board he would be meeting.   He  was  unaware
that he could request an OPB from his servicing Military  Personnel
Flight (MPF).  After receiving notification of non-selection to  Lt
Col, he requested a copy of his “as met” records.  His duty history
was incorrect, his record indicated his duty  assignment  prior  to
his Kuwait tour and his assignment to student status in the  F-15E,
but it did not reflect his assignment with the Office  of  Military
Cooperation, Kuwait.

In support of his  appeal,  the  applicant  provides  a  letter  of
support from Vice Chief OMCK and a printout of  Duty  History  from
his “as met” records.

STATEMENT OF FACTS:

The applicant is presently serving on active duty in the  grade  of
major with a date of rank of 1 May 1999.  His Total Active  Federal
Military Service Date (TAFMSD) is 16 August  1990.   The  applicant
was considered but not selected  for  promotion  to  the  grade  of
lieutenant  colonel  by  the  CY05A  Lieutenant   Colonel   Central
Selection Board.

AIR FORCE EVALUATION:

AFPC/DPAO reviewed this application and stated, in part,  that  his
remote tour to Kuwait was not listed in the duty history, but  that
his performance and accomplishments while in Kuwait on this  remote
assignment were captured on his OPR that closed out on 11  Jan  05,
and that this OPR met the promotion board.  None of the applicant’s
deployments meet the  criteria  to  be  listed  in  the  deployment
history section  of  the  OSB.   DPAO  recommended  correcting  the
member’s duty history with his remote assignment to Kuwait.

AFPC/DPPPO recommends denial of the  applicant’s  request  for  SSB
consideration with a corrected OSB.  DPPPO noted that although  the
28 Feb 04 duty title was not reflected on his P0505A OSB,  the  top
OPR (11 Jan 04 - 11 Jan 05) clearly reflected  his  duty  title  as
“Air  Force  Advisory  Branch,  Office  of  Military  Cooperation.”
Therefore, the central board members had knowledge  that  the  duty
title existed and they were able to  factor  it  in  the  promotion
selection process.

Per SecAF Memorandum of Instruction to the central selection board,
AF policy and Military Personnel  Flight  Memorandum  (MPFM)  05-02
dated 4 Feb 05, only completed deployments of 45 days or  more  and
with the start date of 11 Sep 01 or later will be displayed on  the
member’s OSB.  Current deployments, deployments  that  lasted  less
than 45 days, or deployments that began prior to 11 Sep 01 will not
be reflected.  The applicant had several TDYs, but none equaled  45
days.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 24 Feb 06, a copy of the Air Force evaluation was  forwarded  to
the applicant for review and comment within 30 days.   As  of  this
date, no response has been received by this office (Exhibit E.)

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing
law or regulations.

2.  The application was timely filed.

3.  Insufficient  relevant   evidence   has   been   presented   to
demonstrate the existence  of  error  or  injustice  regarding  the
applicant’s request for promotion consideration by  SSB.   We  took
notice of the applicant's complete submission in judging the merits
of the case; however, we agree with the opinion and  recommendation
of AFPC/DPPPO and adopt its rationale as the primary basis for  our
conclusion that there is no  error  or  injustice  warranting  this
relief.   We  believe  that  the  incorrect  duty  history  on  the
applicant’s OSB constitutes a harmless error.  In  the  absence  of
evidence to the contrary, we find no compelling basis to  recommend
granting the relief sought in this application.

4.  Notwithstanding  our   recommendation   above   regarding   the
applicant’s request for promotion consideration by SSB,  we  accept
the recommendation made  by  AFPC/DPAO  that  the  applicant’s  OSB
should be corrected to reflect his  remote  assignment  to  Kuwait.
Therefore, the Board recommends that  the  applicant’s  records  be
corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the  Air  Force
relating to APPLICANT, be corrected to  show  that  the  Air  Force
Officer Selection Brief prepared for the CY05A  Central  Lieutenant
Colonel Selection  Board  be  amended  in  the  Assignment  History
section to reflect an additional entry onto his OSB which reflects;
Effective 27 February 2004, DAFSC “12F4F,” Duty  Title  “Air  Force
Advisory Branch, Office of Military Cooperation,  Kuwait,”  Command
Level “USCENTCOM,” MAJCOM “ZEC,” Organization “AFELM  Security  AST
JD,” and Duty Location “Kuwait City.”

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:

            The pertinent military records of the Department of the
Air Force relating to [APPLICANT], be corrected to show that the
Air Force Officer Selection Brief (OSB) prepared for the CY05A
Central Lieutenant Colonel Selection Board be amended in the
Assignment History section to reflect an additional entry;
effective 27 February 2004, DAFSC “12F4F,” Duty Title “Air Force
Advisory Branch, Office of Military Cooperation, Kuwait,” Command
