APPLICANT REQUESTS THAT:

His Air Force Commendation Medal (AFCM) be added to  his  Officer  Selection
Record (OSR), and he be granted Special Selection Board (SSB)  consideration
for promotion by the Calendar Year 2005A (CY05A) Lt  Col  Central  Selection
Board (CSB).

APPLICANT CONTENDS THAT:

His AFCM was missing from his records at  the  time  of  the  board.   While
reviewing his OSR prior to the  board,  he  noticed  his  last  two  Officer
Performance Reports (OPRs) were missing from  his  records  and  focused  on
tracking them.  He did not notice he was short one  AFCM  and  believes  the
missing medal might have  influenced  the  board’s  decision.   He  did  not
locate the medal citation until late March/early April 2006.  It  has  since
been added to his record.  In support of the application, he submits a  copy
of his decoration brief.

STATEMENT OF FACTS:

Information extracted from  the  Military  Personnel  Data  System  (MilPDS)
indicates the applicant’s Total Active Federal Military Service Date  is  26
May 1991.  He is currently serving on active duty in  the  grade  of  major,
with a date of rank of 1 January 2002.  The applicant has two  nonselections
for promotion by the CY05A and CY06A Lt Col Central Selection Boards.

The remaining relevant facts pertaining to this application, extracted  from
the applicant’s military records, are contained in the  letter  prepared  by
the appropriate office of the Air Force at Exhibit C.

AIR FORCE EVALUATION:

HQ AFPC/DPPPO recommends denial.   DPPPO  states  the  Officer  Preselection
Brief (OPB) sent to eligible officers prior to a  selection  board  contains
data that will appear on  the  OSB  at  the  central  board.   The  attached
instructions state “Officers will not be considered by a  Special  Selection
Board if, in  exercising  reasonable  diligence,  the  officer  should  have
discovered the error or omission in his/her records  and  could  have  taken
timely corrective action.”  DPPPO notes the applicant indicates  that  prior
to the CY05A board he had the correct medal  types  but  did  not  recognize
that he was short one AFCM.  A  copy  of  the  special  order  and  citation
awarding the AFCM (1OLC) were not provided;  however,  the  attached  MilPDS
printout shows the decoration was awarded in  August  1997.   As  such,  the
decoration should have been updated in the personnel data system about  that
date as well as on file for not only the P0505A board, but also  his  below-
the-zone (BPZ) (CY03A) (8 Jul 03) and CY04B (12 Jul 04) boards as well.   He
was sent an OPB for all three boards, and yet, he failed to ensure  his  OSR
was accurate for all three boards. He did not exercise reasonable  diligence
in ensuring his AFCM (1OLC) was updated on his OSB or citation filed in  his
OSR for any one of these three selection boards.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

In his response dated  7  Sep  06,  the  applicant  reiterates  his  earlier
comments.  He also states that even if he found  the  discrepancy  prior  to
the promotion boards, the correction  would  not  have  occurred  until  now
because he only found the citation during his PCS this past spring  (Exhibit
E.)

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was time filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of probable error or injustice.  The applicant has  requested  SSB
consideration based on the fact that  his  AFCM/1OLC  citation  was  missing
from his OSR when his record met the CY05A Lt Col OSB.  Since his  AFCM/1OLC
was awarded in 1997, we feel the applicant had  ample  opportunity  to  take
corrective action to ensure his  record  was  complete  prior  to  it  being
considered by the promotion board.  Therefore, we  agree  with  the  opinion
and recommendation of the Air Force office  of  primary  responsibility  and
adopt its rationale as the basis for the conclusion that the  applicant  has
not been the victim of an error or injustice.  Based on  the  foregoing,  we
find no basis to  grant  the  relief  sought  in  this  application and  the
applicant’s request for SSB consideration is denied.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of probable material error or injustice; that the  application
was denied without a personal appearance;  and  that  the  application  will
only be reconsidered  upon  the  submission  of  newly  discovered  relevant
evidence not considered with this application.
