APPLICANT REQUESTS THAT:
He be awarded the Armed Forces Expeditionary Medal (AFEM).

APPLICANT CONTENDS THAT:
The medal was awarded to his unit for air recon flights off the Cuban
coast.
In support of the appeal, applicant submits a copy of his DD Forms 214
and a copy of his Army DD Form 214.

STATEMENT OF FACTS:
Applicant is a former member of the Regular Air Force who served on
active duty from 13 July 1966 to 12 July 1970. He served four years
on active duty. He transferred to the Air Force Reserve and on 12
July 1972, he was honorably discharged from the Air Force Reserve.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends denial. DPPPR states the applicant’s military
personnel record indicates his units of assignment were all stateside
assignments and his DD Form 214 reflects no foreign service.
Furthermore, there is no documentation in his military record nor has
he provided any to support his claim.
The AFEM is awarded to members of the service who, after 1 July 1958,
have participated in United States military operations and encountered
foreign armed opposition, or were in danger of hostile action by
foreign Armed Forces. The applicant’s military record does not
reflect any participation in any such military operation.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
17 November 2006 for review and comment within 30 days. As of this
date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
and adopt their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find no
basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

In support of his appeal, the applicant has provided two letters from the Army BCMR transferring his case to the AFBCMR as he was in the US Army Air Corps. The PHM Review Board disapproved his request for award of the PHM on 27 June 2006. Therefore, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
