APPLICANT REQUESTS THAT:
He be awarded the Armed Forces Expeditionary Medal (AFEM).

APPLICANT CONTENDS THAT:
His unit was in Panama in support of Operation Just Cause. They
supported aircrews returning with reconnaissance photos. He was
sent to Egypt in support of Exercise Bright Star 89 to bring
equipment to and from the war games site (25 Sep – 8 Dec 89).
In support of his application, he submits a copy of his DD Form
214, Certificate of Release or Discharge from Active Duty, and a
list of areas designated for award of the AFEM.

STATEMENT OF FACTS:
The applicant served on active duty in the Regular Air Force from
29 Apr 88 to 4 Dec 91. He was discharged with a total of 3 years,
7 months, and 6 days of active military service. His DD Form 214
reflects he was awarded the Air Force (AF) Achievement Medal, AF
Outstanding Unit Award, National Defense Service Medal, Small Arms
Expert Marksmanship Ribbon, AF Good Conduct Medal, Southwest Asia
Ribbon, and the AF Training Ribbon.
On 19 Oct 04, AFPC administratively corrected the applicant’s
DD Form 214 to reflect the Kuwait Liberation Medal (Government of
Kuwait) (KLM-K) and that he served 7 months and 24 days of Foreign
Service.

AIR FORCE EVALUATION:
HQ AFPC/DPPPR recommends the application be denied and states, in
part, that they were unable to find evidence in the member’s
military record to show that he deployed in support of Operation
Just Cause (OJC). The applicant deployed to Egypt in support of
Exercise Bright Star from 14 Sep to 9 Dec 89.
The AFEM was established on 4 December 1961, to be awarded to
members of the United States Armed Forces who, after 1 July 1958,
participated in a United States military operation and encountered
foreign armed opposition, or were in danger of hostile action by
foreign Armed Forces.
The AFEM was awarded to military personnel that were assigned or
attached to Panama in direct support of OJC from 20 Dec 89 to
31 Jan 90. The applicant was assigned to Bergstrom AFB and did not
deploy during the inclusive period for OJC.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 29 Apr 05, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within 30 days. As of this
date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice of
the applicant's complete submission in judging the merits of the
case; however, we agree with the opinion and recommendation of the
Air Force office of primary responsibility and adopt its rationale
as the basis for our conclusion that the applicant has not been the
victim of an error or injustice. Therefore, in the absence of
evidence to the contrary, we find no compelling basis to recommend
granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
