APPLICANT REQUESTS THAT:
His records be corrected to reflect award of the Korean Service Medal (KSM)
and United Nations Service Medal (UNSM) for his assignment in Korea.
[EXAMINER’S NOTE: AFPC/DPPPR has verified the member’s entitlement to the
Korean Defense Service Medal and will correct his DD Form 214 to reflect
award of the KDSM.]

APPLICANT CONTENDS THAT:
He started his Korea overseas duty on 1 Sep 54 and was overseas for 11
months and 29 days.
In support of his request, applicant provided a copy of his DD Form
214, Report of Separation from the Armed Forces of the United States.

STATEMENT OF FACTS:
On 23 Jul 52, the applicant enlisted in the Regular Air Force in the grade
of airman basic for a period of four years. He served as an Aircraft
Mechanic and was progressively promoted to the grade of airman first class.
The applicant’s record indicates he served Foreign Service in Korea from
14 Sep 54 to 29 Aug 55.
On 22 Jul 56, the applicant was released from active duty and transferred
to the Air Force Reserve (AFRES). He served four years on active duty of
which 11 months and 29 days was Foreign Service.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends disapproval of the applicant’s request for award of
the KSM and the UNSM. The KSM is awarded to members of the Armed Forces
for service in Korea, 30 consecutive or 60 nonconsecutive days from 27 Jun
50 to 27 Jul 54. The UNSM is awarded to members of the Armed Forces of the
United States who participated in the action in Korea from 27 Jun 50 to 27
Jul 54. DPPPR states applicant’s deployment to Korea was after the
inclusive dates; therefore, he is ineligible for the KSM or UNSM

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 22 Sep 06, a copy of the Air Force evaluation was forwarded to the
applicant for review and comment within 30 days. As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

The applicant did not provide any documentation to verify his entitlement to the PUC and the KSM w/1 SSS and 3 BSS. On 21 September 2006, the Board staff forwarded the applicant a corrected copy of the Air Force evaluation for his review and response.

His time with the 452nd in Japan was from 15 Nov 50 until 7 Jan 51 (2 months and 7 days) which meets the 30 consecutive days requirement. Applicant’s official record reveals that he served in Japan, from 15 Nov 50 to 7 Jan 51, not in Korea. After a thorough review of the applicant’s submission and the available evidence of record, we are not persuaded that the relief requested should be granted.
