APPLICANT REQUESTS THAT:
The applicant requests entitlement to awards for his foreign service
to Libya, Morocco and a Occupation Medal.

APPLICANT CONTENDS THAT:
He served overseas during the Korean War from June 1953 through July
1954 in Libya and Morocco.
The Veterans of Foreign Wars (VFW) claims he is missing a medal,
possibly a Occupation Medal.
In support of his application, applicant provided a copy of his DD
Form 214.
Applicant's complete submission, with an attachment, is at Exhibit A.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force (RegAF) on 16 January
1953, as an airman basic (AB) for a period of four years.
His records reflect he was awarded the Good Conduct Medal (GCM) and
the National Defense Service Medal (NDSM).
The applicant’s Air Force (AF) Form 7 reflects he had Foreign Service
to Libya and Morocco from 4 August 1953 to 25 September 1954.
The applicant was honorably released from active duty on 16 January
1957. He served four years of active duty service.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends the requested relief be denied. DPPPR states
they were unable to verify any additional awards for the applicant’s
Foreign Service. They further state the applicant has not provided
any source documents to verify his entitlement to any additional
awards for his Foreign Service. In regard to the applicant’s
entitlement to an Occupational Medal, the applicant’s Foreign Service
does not fall within the awarding dates and areas of eligibility.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 1 September 2006, a copy of the Air Force evaluation was forwarded
to the applicant for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and the recommendation of the Air
Force and adopt its rationale as the basis for our conclusion that the
servicemember has not been the victim of an error or an injustice.
There was no documentation provided by the applicant or located in his
military records to verify his units of assignments and foreign
service entitled him to any additional awards for his service in Libya
and Morocco. Furthermore, the applicant’s dates of foreign service do
not fall within the dates for award of the Army of Occupation
of Korea Medal. While we are not unmindful or unappreciative of the
applicant’s service to his Nation, in the absence of evidence to the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

In addition, they verified his entitlement to the Air Force Good Conduct Medal and the Armed Forces Expeditionary Medal with one Bronze Service Star, and indicated his separation document will be updated to reflect these awards (Exhibit E). He did not provide an order awarding him the AM, and they were unable to verify his entitlement to the award. After a thorough review of the evidence of record and applicant’s submission, we are unpersuaded he should be awarded the AM.
