APPLICANT REQUESTS THAT:

His records be corrected to reflect award of  the  Republic  of  Korea
Presidential Unit Citation  (ROKPUC),  Korean  Defense  Service  Medal
(KDSM), Air and Space Campaign Medal (ASCM) and  the  Kosovo  Campaign
Medal (KCM).

EXAMINER’S NOTE:  On 21 August 2006, a DD Form 215 was  issued  adding
the KDSM, ASCM and the ROKPUC to the applicant’s records.   Therefore,
the only remaining issue before the Board is the award of the KCM.

APPLICANT CONTENDS THAT:

These awards should be added to his DD Form 214.

In  support  of  his  application,  applicant  provided  a  statement,
Enlisted  Performance  Reports  (EPRs),  Special  Order  (SO)  GA  78,
Meritorious Service Medal (MSM) Certificate.

Applicant's complete submission,  with  attachments,  is  attached  at
Exhibit A.

STATEMENT OF FACTS:

The applicant enlisted in the Air Force Reserve on 21 February 1980 in
the grade of airman basic (AB) for a period of six years.

His records reflect he was awarded the  Air  Force  Achievement  Medal
(AFAM),  Air  Force  Commendation  Medal  (AFCM)  with  two   devices,
Meritorious Service Medal (MSM) with two devices, Air Force  Longevity
Service Award (AFLSA) with four devices, Air  Force  Training  Ribbon,
Air Force Overseas Short  Tour  Ribbon  with  one  device,  Air  Force
Overseas Long Tour Ribbon with three devices, National Defense Service
Medal (NDSM) Air Force Basic Military Training  (BMT)  Honor  Graduate
Ribbon, Small Arms Expert Marksmanship  Ribbon/Rifle,  NonCommissioned
Officer (NCO) Professional Military Education Ribbon with one  device,
Air Force Outstanding Unit Award with Valor  with  five  devices,  Air
Force Organizational Excellence Award, Air Force  Good  Conduct  Medal
with five devices.

The applicant was honorably retired on 1 January 2001 in the grade  of
master sergeant (MSgt).  He served 20 years, 2 months and 25  days  of
active duty service.

AIR FORCE EVALUATION:

HQ AFPC/DPPPR recommends the requested relief be denied.  DPPPR states
the applicant’s entitlement to the KDSM, ASCM and the ROKPUC has  been
verified and his records were corrected administratively.

The KCM is awarded to  military  servicemembers  participating  or  in
direct support  of  Kosovo  operations  within  established  areas  of
eligibility for 30 consecutive or 60 nonconsecutive days.

A complete copy of the Air Force evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 1
September 2006, for review and response.  As of this date, no response
has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and the recommendation of  the  Air
Force and adopt its rationale as the basis for our conclusion that the
applicant has not been the victim of an error  or  an  injustice.   As
stated the applicant’s records will be updated to reflect award of the
KDSM, ASCM, and ROKPUC.  The applicant did not meet the  criteria  for
award of the KCM.  After thoroughly reviewing the applicant’s military
personnel records, we found no evidence showing he served in the  area
of eligibility for 30 consecutive or 60 consecutive  days.   While  we
are not unmindful or unappreciative of the servicemember’s service  to
his Nation, in the absence of evidence to the  contrary,  we  find  no
compelling basis to recommend  granting  the  relief  sought  in  this
application.  However,  should  the  applicant  provide  documentation
substantiating he was deployed to Kosovo, this Board would be  willing
to review the materials for possible reconsideration.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
