APPLICANT REQUESTS THAT:

His records be corrected to show he was awarded the Korean  Defense  Service
Medal (KDSM) and to reflect 10% Combat Related Disability under the  Combat-
Related Special Compensation (CRSC) program.

Examiner’s Note:  In a letter dated 8 June  2005,  the  applicant’s  request
for 10% CRSC was approved.  Therefore, only the KDSM will be addressed.

APPLICANT CONTENDS THAT:

The KDSM was enacted after his  discharge.   The  DD  214  is  provided  for
certain benefits and employment and should be correct.  The separate,  stand
alone documentation provided by the Air Force  does  not  provide  the  same
level of sufficiency as an annotated DD 214.  He would like a  corrected  DD
214 for already approved items.

In  support  of  his  application,  the  applicant  submits  a  copy  of   a
transmittal of and/or entitlement to award for the KDSM, a copy of his  CRSC
approval letter, and a copy of a letter from the National Personnel  Records
Center (NPRC).

The applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant was honorably relieved from active duty  on  29 February  1996
and retired in the grade of captain effective 1 March 1996.   Applicant  was
credited with 12 years, 4 months and 5  days  of  active  duty  commissioned
service and 11 years and 8 days of  total  prior  active  duty  service,  to
include 13 years, 8 months and 29 days of Foreign Service.

The applicant’s records indicate he was assigned to duties  in  Germany  and
Japan.  His awards include the Air Force Achievement Medal w/2 devices,  the
Air Force Commendation Medal  w/3 devices, the  Air  Force  Training  Ribbon
w/1 device, the Air  Force  Overseas  Long  Tour  Ribbon  w/3  devices,  the
National Defense Service Medal w/1 device, the Air Force  Longevity  Service
Award w/4 devices, the Small Arms Expert  Marksmanship  Ribbon  w/1  device,
the Air Force Good Conduct Medal w/2 devices, the NCO professional  Military
Education Ribbon, the Armed Forces Reserve Medal w/1  device,  and  the  Air
Force Outstanding Unit award w/Valor w/8 devices.

Examiner’s  Note:   The  Defense  Finance  and  Accounting  Service   (DFAS)
verified the applicant was paid Foreign Service Assignment  (FSA)  pay,  but
was not able to verify where he served when he received FSA pay.

AIR FORCE EVALUATION:

HQ AFPC/DPPPR recommends denial.  DPPPR states individuals  must  have  been
assigned, attached, or mobilized to units operating or serving  on  all  the
land area of the Republic of Korea, and the  contiguous  waters  out  to  12
nautical miles, and all airspace above all the land area of Korea and  water
areas.  To be eligible for award of  the  KDSM,  personnel  must  have  been
physically present in the aforementioned areas  for  30  consecutive  or  60
nonconsecutive days.

The NPRC approved the applicant for award of  the  KDSM;  however,  after  a
thorough review of his records, DPPRS was unable  to  verify  the  applicant
served in Korea for 30 consecutive days  or  60  nonconsecutive  days.   His
performance reports state he was assigned duties in support  of  Korea  from
Japan.  DPPPR requests the applicant provide documentation (travel  voucher,
TDY orders, citation, etc.) to verify his entitlement to the KDSM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

In his letter dated 13 Oct 06, the applicant provided a copy of his  special
order TE-0188 transferring him to Osan AB, Korea, for 60 days and a copy  of
the amendment of the order increasing his stay to 68 days.  These  documents
were used by NRPC to approve the KDSM (Exhibit E).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of probable error or injustice warranting the  applicant’s  record
be corrected to show  he  was  awarded  the  Korean  Service  Defense  Medal
(KDSM).  The supporting documentation provided by  the  applicant  indicates
he served in Korea for 68 days,  which  would  qualify  him  for  the  KDSM.
Therefore we strongly recommend his records  be  corrected  to  reflect  his
award of the KDSM.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT be corrected to show that he  be  awarded  the  Korean  Defense
Service Medal for service in Korea during the period of 19 May  1995  to  27
July 1995.
