APPLICANT REQUESTS THAT:
His records be corrected to reflect he was awarded the Meritorious
Service Medal first Oak Leaf Cluster (1 OLC), Air Force Commendation
Medal (3 OLC) with Valor, the Kosovo Campaign Medal (KCM), the
Afghanistan Campaign Medal (ACM), the Global War on Terrorism
Expeditionary Medal (GWOT-E) and the Air Force Expeditionary Service
Ribbon with Gold Border (AFESR w/GB).

APPLICANT CONTENDS THAT:
He received these awards after he retired. The campaign medals and
ribbons were announced after his retirement.
In support of his appeal, applicant submitted copies of his award
certificates, special orders, e-mail communiqué, AF IMT 3994,
Recommendation for Decoration Deployment/Contingency Operations and
his DD Form 214, Certificate of Release or Discharge from Active Duty.

STATEMENT OF FACTS:
The applicant served on active duty from 19 Aug 82 through 31 May 05.
He served in Saudi Arabia from 22 Jan 03 through 19 May 03. The
applicant retired on 1 Jun 05. He served on active duty for 22 years,
9 months and 15 days.
On 31 Aug 07, AFPC/DPSIDR notified the applicant that his eligibility
for the MSM (1 OLC), AFCM w/V (3 OLC), GWOT-E, AFESR w/GB, and the
Global War on Terrorism Service Medal had been
verified and his records will be updated to reflect the awards.

AIR FORCE EVALUATION:
HQ AFPC/DPSIDR recommends denying the applicant’s request for award of
the ACM and KCM. The KCM is awarded to service members participating
or in direct support of Kosovo operations within established areas of
eligibility (AOE). Service members are authorized the KCM in direct
support of the operation for 30 consecutive or 60 nonconsecutive days
in the AOE. No official documentation was located to verify the
applicant’s eligibility for the KCM.
Service members are eligible for the ACM if they were assigned or
attached to a unit participating in Operation Enduring Freedom for 30
consecutive or 60 nonconsecutive days in Afghanistan. No official
documentation was located to verify the applicant’s participation in
Afghanistan.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant 14
Sep 07, for review and response within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and the recommendation of the Air
Force office of primary responsibility and adopt its rationale as the
basis for our conclusion that the applicant has not been the victim of
an error or injustice. Therefore, in view of the foregoing, we find
no compelling basis upon which to recommend the requested relief other
than that which has been administratively accomplished.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
