RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2010-00257 INDEX CODE: 107.00 COUNSEL: NONE HEARING DESIRED: NO _________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect award of the Air Force Expeditionary Service Ribbon (AFESR), the Air Force Expeditionary Service Ribbon with Gold Border (AFESR w/GB), and the Kosovo Campaign Medal (KCM). _________________________________________________________________ APPLICANT CONTENDS THAT: He left military service in 2001 and the AFESR was created in 2003 for contingency deployments after October 1999 for participation in support of Operation ALLIED FORCE. In support of his request, the applicant provides copies of his DD Form 214 and certificate for award of the Air Force Achievement Medal (AFAM). The applicant's complete submission, with attachments, is at Exhibit A. _________________________________________________________________ STATEMENT OF FACTS: The applicant’s DD Form 214 reflects he served on active duty from 27 Aug 97 through 26 Jun 01. He served as an Aerospace Maintenance Journeyman. The applicant served in the Royal Air Force Mildenhall, United Kingdom, from 24 Mar 99 to 10 Jun 99. On 23 Jun 10, the applicant was notifed that his entitlement to the Air and Space Campaign Medal (ASCM) and the AFESR was verified and that his records will be administratively updated. _________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIDR recommends denial for award of the AFESR w/GB and KCM. DPSIDR states the AFESR with GB was authorized in April 2004 to represent participation in combat operations awards. The KCM is awarded to service member who served in direct support of the operation for 30 consecutive or 60 nonconsecutive days in the Area of Responsibility (AOR). DPISIDR was unable to locate any official documentation to verify the applicant’s entitlement to the KCM. DPSIDR further notes, the applicant’s entitlement to the ASCM and AFESR was verified and his records will be administratively corrected to reflect award of the medals. The complete AFPC/DPSIDR evaluation is at Exhibit C. _________________________________________________________________ APPLICANT REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 Jul 10, for review and comment within 30 days. As of this date, no response has been received by this office. _________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or an injustice. We took note of the documentation provided in support of the applicant’s request for award of the AFESR w/GB and the KCM; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our decision that the applicant has failed to sustain his burden of proof of the existence of an error or injustice. The applicant is not eligible for the AFESR w/GB due his being discharged in June 1999 and the ribbon was not authorized until April 2004. In addition, there was no official documentation located verifying he served in the AOR for award of the KCM.
