APPLICANT REQUESTS THAT:
His DD Form 2839, Career Status Bonus (CSB) Election date be changed from
28 Apr 06 to 21 Apr 06; to render him eligible to receive the Career Status
Bonus.

APPLICANT CONTENDS THAT:
His DD Form 2839 was incorrectly dated.
In support of his request, applicant provided a copy of his DD Form
2839.

STATEMENT OF FACTS:
Applicant is currently serving on active duty in the grade of technical
sergeant. He entered active duty on 22 Apr 91. The applicant’s 14 years
and 6 months of active duty was on 22 Oct 05 with a 15-year point of active
duty of 22 Apr 06.
On 28 Apr 06, the applicant made his election for the CSB.

AIR FORCE EVALUATION:
AFPC/DPPRR recommends denial. Based on Air Force policy, the applicant’s
window of opportunity is past the suspense and he is no longer eligible for
this program. The applicant did not provide any information/supporting
documentation to explain as to why he believes the form was dated
incorrectly.
CSB eligibility notification should be provided on or before the date a
member completes 14 years and 6 months of active duty. Once a member makes
an election at 15 years of active service, they must agree to remain on
continuous active duty for a minimum of 20 years of service. If a member
is not eligible or has not made an election for CSB by the 16th year of
active service, the member remains in High-3/50% retirement plan and is no
longer eligible for the CSB program. The member should be notified at
least one other time before reaching 16 years active service, that failure
to select CSB option will result in High-3/50% retirement plan.
The member was notified of his CSB eligibility on 14 Oct 05, 8 days prior
to his 14 years and 6 months of active duty service which was 22 Oct 05.
The member had six months from the time of notification to make an election
which would take the member to his 15-year point of active duty of 22 Apr
06.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 16 Jun 06, a copy of the Air Force evaluation was forwarded to the
applicant for review and comment within 30 days. As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence the applicant was not properly notified or why
he believes the form was incorrectly dated, we find no compelling basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
