RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-2006-00315
            INDEX CODE: 128.00

            COUNSEL: NONE

            HEARING DESIRED: NO

MANDATORY CASE COMPLETION DATE: 5 AUG 07

_________________________________________________________________

APPLICANT REQUESTS THAT:

He be allowed to elect the Career Status Bonus (CSB).

_________________________________________________________________

APPLICANT CONTENDS THAT:

His previous squadron at Dover AFB, DE, never informed him in writing or
verbally of the CSB. He further indicates no documentation is in his
military personnel records and no update to the Military Personnel Data
System (MilPDS) was ever input for this option.

Applicant’s complete submission, with attachment, is at Exhibit A.

_________________________________________________________________

STATEMENT OF FACTS:

The applicant’s Date of Initial Entry into Military Service (DIEMS) is 13
June 1988.

On 27 December 1988, the applicant entered active duty in the Regular Air
Force. He continued to reenlist contracting his last enlistment on 13
November 2001 for a period of four years. He is currently serving in the
grade of technical sergeant (TSgt) effective and with a date of rank (DOR)
of 1 March 2003.

The applicant’s 14 years and 6 months of active duty was on 27 June 2003
with a 15-year point of active duty of 27 December 2003.

Pursuant to an Air Force Board for Correction of Military Records (AFBCMR)
staff inquiry to the Air Force Personnel Center (AFPC) requesting a copy of
the CSB notification letter to the applicant - AFPC/DPPRR has indicated
that they requested the applicant’s base to review the applicant’s records
and provide them a copy of the CSB notification letter that was sent to the
applicant; however, they were unable to provide a copy of the notification
letter. In addition, AFPC has no record of the CSB notification letter
that was sent to the applicant.

In accordance with Public Law 106-65, effective 5 October 1999, changes
were made to the retired pay system. Service members who initially entered
the uniformed service on or after 1 August 1986 were given a choice of
retirement plans at their 15th year of service. Their two options were to
take the pre-1986 retirement system (High-3 System) or elect to receive a
one-time lump-sum Career Status Bonus (CSB) of $30,000.00 at 15 years of
service in exchange for length-of-service retired pay computed under the
post-1986 retirement system (the Military Retirement Reform Act of 1986,
commonly known as REDUX). This option is referred to jointly as the
CSB/REDUX option.

AIR FORCE EVALUATION:

AFPC/DPPRR recommended denial indicating if a member is not eligible or has
not made an election for CSB by the 16th year of active service, the member
remains in High-3/50% retirement plan and is no longer eligible for the CSB
program. CSB eligibility notification should be provided on or before the
date a member completes 14 years and 6 months of active duty. The
applicant’s 14 years and 6 months of active duty was 27 June 2003 with a
15 years point of active duty of 27 December 2003.

Based on Air Force policy, the applicant’s window of opportunity is past
suspense and he is not longer eligible for this program. The applicant
does not provide any information whether he inquired to his commander,
Command Support Squadron, or servicing Military Personnel Flight (MPF)
regarding CSB eligibility at anytime in the past two years. AFPC handled
the applicant’s case properly. Information and criteria for this program
are available through many sources to include, but not limited to, the MPF,
DOD and AFPC websites, and Base Career Advisors.

The evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 3 March 2006, a copy of the Air Force evaluation was forwarded to the
applicant for review and response within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by existing law or
regulations.

2. The application is timely filed.

3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. In this respect, we note that in
accordance with Public Law 106-65, effective 5 October 1999, changes were
made to the retired pay system. Service members who initially entered the
uniformed service on or after 1 August 1986 were given a choice of
retirement plans at their 15th year of service - CSB/REDUX option. The
applicant’s DIEMS date is 13 June 1988, which makes him eligible for the
CSB. The CSB eligibility notification letter should have been provided to
the applicant on or before the date he completed 14 years and 6 months of
active duty service. In the applicant’s case this was on 27 June 2003.
The applicant contends that he was never informed in writing or verbally of
the CSB. The Board notes that AFPC/DPPRR has indicated that the
applicant’s base and AFPC were unable to provide a copy of the CSB
notification letter that was supposed to have been provided to the
applicant. Therefore, the Board is of the opinion that the applicant was
never notified of the CSB. In view of the above findings and in an effort
to offset any possibility of an injustice, we recommend the applicant’s
records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that on 28 June 2003, he executed a DD
Form 2839, Career Status Bonus (CSB) Election Form, electing the Career
Status Bonus.
