APPLICANT REQUESTS THAT:

His records be corrected to reflect his award of  the  Air  Medal  (AM)  and
Vietnam Service Medal (VSM).

APPLICANT CONTENDS THAT:

His DD Form 214, Armed Forces of the United States  Report  of  Transfer  or
Discharge, is missing the requested awards.  He would like the  certificates
and medals for both replaced in order to pass them onto his son.

In support of his application, the applicant provides a copy of his DD  Form
214.

The applicant’s complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

On 2 July 1963, the applicant enlisted in the Regular Air Force at  the  age
of 21 in the grade of airman basic for a period of four  years.   He  served
as an Aircraft Mechanic and was  progressively  promoted  to  the  grade  of
airman first class (E-4) effective 21 June 1966 and with a date of  rank  of
1 June 1966.  The applicant’s record indicates he served foreign service  in
the Philippines.

On  16  June  1967,  the  applicant  was  released  from  active  duty   and
transferred to the Air  Force  Reserve  (AFRES).   He  served  3  years,  11
months, and 15 days on active duty of which 1 year, 6  months  and  21  days
was foreign service.  The applicant’s DD Form 214  reflects  his  awards  as
the National Defense Service Medal, Air Force Outstanding  Unit  Award,  and
Small Arms Expert Marksmanship Ribbon.  On 1 July 1969,  the  applicant  was
honorably discharged from the AFRES.

AIR FORCE EVALUATION:

AFPC/DPPPR recommends disapproval of the applicant’s request  for  award  of
the AM.  DPPPR states after a complete review of  the  applicant’s  official
military record and provided documentation, they were unable to  verify  his
entitlement to the AM.  In addition, they were unable to find  any  evidence
of a recommendation for, or award of, the AM.

DPPPR was able to verify the applicant’s entitlement to the VSM based  on  a
60-day temporary duty (TDY) he served in Vietnam.  On  17 August  2006,  the
applicant’s was sent a DD Form 215, Correction to DD  Form  214,  indicating
his records had been corrected to reflect his award of the  VSM.   Following
notification of his records being corrected to  reflect  his  award  of  the
VSM, the applicant requested  his  records  also  be  corrected  to  reflect
additional service time in Vietnam in the  amount  of  300  days  versus  60
days.  DPPPR states the AFPC  Directorate  of  Assignments  were  unable  to
verify the applicant served any time in Vietnam other than his  60-day  TDY,
therefore, DPPPR recommends denial of the  applicant’s  request  to  correct
his record to reflect additional time served in Vietnam.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:


A copy of the Air Force evaluation was  forwarded  to  the  applicant  on  1
September 2006, for review and comment within 30 days.   As  of  this  date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence  of  error  or  injustice.   We  note  AFPC  has  administratively
corrected  the  applicant’s  records  to  reflect  his  award  of  the  VSM;
therefore, we will only  address  his  request  for  award  of  the  AM  and
additional duty time in Vietnam.  After a thorough review of  the  available
records, we found no evidence that the applicant is eligible for  the  award
of the AM.  We  note  the  applicant’s  assertion  that  he  was  previously
awarded the AM; however, there is no indication in  the  applicant’s  record
that he was  recommended  for,  or  awarded,  the  AM.   We  also  note  the
applicant’s additional contention that he served approximately 300  days  in
Vietnam; however, we find no evidence to support this  contention  beyond  a
60-day temporary duty in Vietnam.   The  personal  sacrifice  the  applicant
endured for his  country  is  noted  and  the  recommendation  to  deny  the
requested relief in no way diminishes  the  high  regard  we  have  for  his
service.  Nevertheless, in view of the above, we find no basis to  favorably
consider this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
