APPLICANT REQUESTS THAT:
His DD Form 214, Report of Separation from Active Duty, be corrected to
reflect he served two tours of duty in Vietnam and that he was awarded Two
Oak Leaf Clusters to the Vietnam Service Medal (VSM w/2OLC).
EXAMINER’S NOTE: In the applicant’s letter dated 17 April 2004, it appears
he is requesting corrective action relating to medical issues. On 20
October 2004, the Board staff advised the applicant they were unable to
determine what correction he desired to his records with regard to medical
issues and indicated his case would be held in abeyance for 14 days. If no
response was received, his case would be presented to the Board with the
requested action for award of the VSM w/2OLC and finalized. As of this
date, no response has been received.

APPLICANT CONTENDS THAT:
He served two tours in Vietnam and is entitled to two Oak Leaf Clusters to
the VSM.

STATEMENT OF FACTS:
On 21 February 1967 the applicant enlisted in the Regular Air Force in the
grade of airman basic for a period of four years. He contracted his last
enlistment on 2 December 1970 in the grade of sergeant for a period of four
years.
On 8 December 1974, the applicant was honorably discharged in the grade of
sergeant, under the provisions of AFM 39-10. He served 7 years, 9 months,
and 18 days of total active duty service.
The applicant’s DD Form 214 reflects he was awarded the following
decorations and citations: the National Defense Service Medal, Vietnam
Service Medal, Republic of Vietnam Campaign Medal, Air Force Good Conduct
Medal with Two Oak Leaf Clusters, Air Force Longevity Service Award with
Two Oak Leaf Clusters, and the Air Force Outstanding Unit Award with One
Oak Leaf Cluster.

AIR FORCE EVALUATION:
AFPC/DPAPP2 recommended denial indicating the applicant’s records only have
documentation regarding one temporary duty (TDY) tour in Vietnam. On 26
May 2004, they requested he provide any documentation to confirm an
additional tour to Vietnam. However, he did not respond. Without source
documents, there is nothing confirming an additional tour of duty to
Vietnam.
The evaluation, with attachment, is at Exhibit C.
AFPC/DPPPR recommended denial. They indicated the applicant was on a TDY
assignment for three months during the reporting period of 21 February 1967
to 20 February 1968. While assigned to his stateside unit at Norton AFB,
CA, he did receive a VSM for this TDY assignment. However, they were
unable to verify his entitlement to any additions to the medal which would
have been Bronze Service Stars (BSS) not Oak Leaf Clusters. He did receive
the Republic of Vietnam Campaign Medal for his temporary duty assignment.
On 14 July 2004, they requested additional documents of assignment. He did
not respond. Therefore, they are unable to verify his entitlement to any
additional devices to his VSM. His military record does reflect his
service in Vietnam.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 13 August 2004, copies of the Air Force evaluations were forwarded to
the applicant for review and response within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or an injustice. The applicant’s contentions are
duly noted; however, after thoroughly reviewing the applicant’s submission,
the Board is not persuaded the applicant’s DD Form 214 should reflect he
served two tours of duty in Vietnam nor should it reflect any additional
devices to his VSM. The Board notes the applicant’s military personnel
records reflect he served one TDY tour in Vietnam from 18 February 1968 to
6 August 1968 and received the Republic of Vietnam Campaign Medal and
Vietnam Service Medal for this TDY assignment. On 26 May 2004,
HQ AFPC/DPAPP1 advised the applicant that his records reflect one TDY to
Vietnam and requested he provide documents (i.e., PCS orders, travel
vouchers, TDY orders) to verify the unit he was assigned to in Vietnam.
However, he did not respond. The personal sacrifice the applicant endured
for his country is noted and our decision in no way diminishes the high
regard we have for his service; however, insufficient documentary evidence
has been presented to warrant the requested relief. Therefore, in the
absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought.
4. It is unclear to the Board whether the applicant is requesting
further relief with regard to any medical condition he may have incurred
while on active duty. He was asked to clarify his request, but did not
respond. Should the applicant provide further information regarding this
issue, the Board would be willing to review the application for possible
reconsideration. In the meantime, we would encourage the applicant to
contact his nearest Department of Veterans Affairs regarding any medical
issues.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not demonstrate the
existence of an error or an injustice; the application was denied without a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered with this
application.

The AFOSR-S and the AFOSR-L were authorized on 12 Oct 80, and awarded to Air Force active duty, Reserve, and National Guard personnel who have been awarded credit for an OS tour after 1 Sep 80. In this regard, the AFOSR-S and the AFOSR-L were authorized on 12 Oct 80 for those members who had been credited with an OS tour after 1 Sep 80. The applicant did not complete an OS tour after that date.

On 22 July 2003, HQ AFPC/DPAPP2 advised the applicant there were no documents in his personnel file that reflected he was on temporary duty (TDY) to Vietnam. They indicated that they have thoroughly reviewed the applicant’s records and they are unable to find any indication that he was TDY from the Philippines to Vietnam at any time. His assignment to Thailand is after the closeout date for award of the Vietnam Service Medal.
