APPLICANT REQUESTS THAT:

He be awarded the Joint Meritorious Unit Award (JMUA) and  the  Korean
Defense Service Medal (KDSM).

Note: Applicant’s records will be changed to reflect the award of  the
KDSM.

APPLICANT CONTENDS THAT:

He was awarded both awards after his retirement and  would  like  them
added to his DD Form 214, Certificate of  Release  or  Discharge  from
Active Duty.

In support of his appeal, the applicant has provided copies of his  DD
Form 214, awards and decorations paperwork, and  Permanent  Change  of
Station (PCS) and travel documents.

Applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

He enlisted in the Regular  Air  Force  on  15  August  1973  and  was
progressively promoted to the grade of master sergeant with a date  of
rank of 1 February 1991.  He was honorably discharged on  28  February
1994 under the provisions of AFR 35-7 (Voluntary Retirement).  He  was
credit with 20 years, 6 months and 16 days  of  active  service  which
included 4 years, 11 months, and 28 days of overseas service.

AIR FORCE EVALUATION:

AFPC/DPPPR notes the JMUA is awarded in the name of the  Secretary  of
Defense (SECDEF) to joint activities for  meritorious  achievement  or
service, superior to that which is normally expected, for  actions  in
the following situations: combat with an armed  enemy  of  the  US,  a
declared national emergency, or under extraordinary circumstances that
involve national interests.  DPPPR was unable  to  locate  any  source
documents in his service record that indicated he was entitled to  the
JMUA.  However, DPPPR was able to verify his entitlement to  the  KDSM
based  on  his  deployment  to  OSAN  Air  Base,  Republic  of  Korea.
Therefore he will be awarded the  KDSM  and  his  records  changed  to
reflect such; however, DPPPR recommends award of the JUMA be denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  on
21 July 2006 for review and comment within 30 days.  As of this  date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt its rationale as the  basis
for our conclusion that the applicant has not been the  victim  of  an
error or injustice.  The Air Force  was  unable  to  verify  from  the
available record any evidence he  was  ever  eligible  for  the  JMUA.
Therefore, in the absence of evidence to  the  contrary,  we  find  no
compelling basis to recommend  granting  the  relief  sought  in  this
application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
