APPLICANT REQUESTS THAT:
She be reimbursed for premiums paid on her Family Servicemember’s Group
Life Insurance (FSGLI).

APPLICANT CONTENDS THAT:
In June 2005, $90.00 for FSGLI was deducted from her pay without her
knowledge. She submitted her declination statement for FSGLI; however,
$7.50 was still deducted from July through October 2005.
In support of her appeal, applicant submits a copy of her Family Coverage
Election, and copies of her Leave and Earnings Statement from May through
October 2005. Applicant’s submission is at Exhibit A.

STATEMENT OF FACTS:
As of 31 July 2005, the Defense Finance and Accounting Service system
reflects deduction of FSGLI premiums have stopped and the FSGLI premiums
withdrawn from July 2005 through October 2005 have been reimbursed to the
applicant.
The remaining relevant facts pertaining to this application are contained
in the letter prepared by the appropriate office of the Air Force at
Exhibit B.

AIR FORCE EVALUATION:
AFPC/DPW recommends the application be denied. DPW states the Air Force
took adequate steps to inform all members of this new program and the
applicant had adequate time between 1 November 2001 - 31 December 2001 to
make an election decision. The DPW evaluation is attached at Exhibit B.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 16 December 2005, a copy of the Air Force evaluation was forwarded to
the applicant for review and response. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. The applicant was properly charged with a
debt as a result of the passage of Public Law 107-14, effective 1 November
2001, which automatically extended Servicemember’s Group Life Insurance
(SGLI) coverage to spouses and children. Since the applicant did not
provide any documentation to indicate she was not aware of this change and
her responsibility to make an election, it is the Board majority’s opinion
that no basis exists to reimburse the premiums withheld. However, in
regard to the FSGLI premiums withheld from July through October 2005, the
Board took note that as of 31 July 2005, the Defense Finance and Accounting
Service reimbursed the applicant for these FSGLI premiums and deduction of
FSGLI premiums have ceased.

RECOMMENDATION OF THE BOARD:
A majority of the Board finds insufficient evidence of error or injustice
and recommends the application be denied.

On 13 June 2003, the applicant declined FSGLI coverage on SGLV 8286A, Family Coverage Election. The applicant’s Leave and Earnings Statement dated for the month of May 2003, indicates a total debt of $360 for FSGLI premiums from 1 November 2001 through 30 April 2003. DPW states that in accordance to public law, although premiums had not yet been deducted from her pay, the applicant’s spouse was insured for $100,000 for the period 1 November 2001 through 30 June 2003.
