APPLICANT REQUESTS THAT:
Her late husband’s records be corrected to show that he spent time in Korea
and he be awarded the Korean Defense Service Medal (KDSM).

APPLICANT CONTENDS THAT:
Her late husband’s separation document does not state his veteran status.
In support of the application, the applicant submits a copy of her late
husband’s separation document and death certificate. The applicant's
complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
On 26 January 1954, the former member enlisted in the Regular Air Force at
the age of 19 in the grade of airman basic for a period of four years. He
was progressively promoted to the grade of staff sergeant, effective date
of rank 1 September 1957. Effective 6 August 1955, applicant was assigned
duties at Bitburg AB, Germany, and returned to the Continental U.S. on or
about 10 December 1956.
He was honorably released from active military service on 13 December 1957
by reason of Convenience of the Government – overseas Returnees with under
180 days remaining until Expiration of Term of Service. He was credited
with 3 years, 10 months and 18 days of total active service to include 2
years, 4 months, and 16 days of Foreign Service (Bremerhaven, Germany).
His awards included the National Defense Service Medal and the Good Conduct
Medal.

AIR FORCE EVALUATION:
HQ AFPC/DPPPR recommends denial. DPPPR states the KDSM was authorized by
the Fiscal Year 2003 National Defense Authorization Act for military
members. In February 2004, the Department of Defense approved the KDSM to
Air Force Active Duty, Reserve, and Guard personnel as recognition for
military service in the Republic of Korea and the surrounding waters after
28 July 1954 and ending on such a future date as determined by the
Secretary of Defense. DPPPR affirms they were unable to verify any
assignment in Korea by the former member and therefore were unable to
verify his entitlement to the KDSM.
DPPPR states they were, however, able to verify the former member’s
assignment to Germany, and determined that he is entitled to the Air Force
Outstanding Unit Award. DPPPR’s evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant for
review and comment on 8 April 2005. As of this date, this office has
received no response (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. We took notice of the applicant’s
contention that her late husband should be awarded the KDSM for time served
in Korea; however, sufficient evidence has not been presented to
substantiate this claim. We thoroughly reviewed the former member’s
records and were unable to find any evidence that he was ever assigned to
Korea. Therefore, we agree with the opinion and recommendation of the Air
Force office of primary responsibility and adopt its rationale as the basis
for our conclusion that the former member has not been the victim of an
error or injustice. However, should the applicant provide new evidence
which substantiates her claim, we will review the new evidence and
reconsider this application.

The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the application
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.
