APPLICANT REQUESTS THAT:
Her deceased father’s records be corrected to reflect his service in
the Korean War and award of the Korean Defense Service Medal.

APPLICANT CONTENDS THAT:
Her father served in the Korean War and his records should reflect his
service.
In support of the request, the applicant submits a copy of her
father’s Certificate of Death, DD Form 214, Report of Separation from
the Armed Forces of the United States, and a copy of DD Form 256AF,
Honorable Discharge from the Armed Forces of the United States of
America.

STATEMENT OF FACTS:
The deceased former member enlisted in the Air Force on 29 Jul 52, for
a term of four years and was progressively promoted to the grade of
airman third class. He was released from active duty on 13 Aug 56,
and received an honorable discharge service characterization. He
served a total of 3 years, 11 months and 22 days active duty service.
His DD 214 reflects award of the National Defense Service Medal.
The KDSM is awarded for military service in the Republic of Korea
(ROK) and surrounding waters after 28 July 1954, to a date to be
determined by the Secretary of Defense. Individuals must have been
assigned, attached, or mobilized to units operating or serving on all
the land area of the ROK, and the contiguous waters out to 12 nautical
miles, and all airspace above all the land area of Korea and waters
areas. To be eligible for the KDSM, personnel must have been
physically present in the areas above for 30 consecutive days or 60
nonconsecutive days. Service member must have been assigned, attached
or mobilized to units operating in the area of eligibility for 30
consecutive or 60 nonconsecutive days.

AIR FORCE EVALUATION:
AFPC/DPAPP recommends denial, and states, in part, that after a
careful review of the deceased former member’s available records,
there was no documentation to substantiate any service in Korea. The
applicant indicated she sent everything to the National Personnel
Records Center. While she did not indicate what the documentation
was, she was asked to send copies of whatever documents she possessed
and she did not respond.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
29 Feb 08, for review and comment within 30 days. As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. The applicant has not submitted
persuasive evidence to substantiate the request, nor does the evidence
of record reflect her father served in Korea. Should the applicant
provide such evidence, the Board would be willing to reconsider her
request. As such, since no evidence has been provided to show her
father served in Korea he does not meet the criteria for award of the
KDSM. In view of the above and in the absence of evidence to the
contrary, we find no compelling basis to warrant favorable
consideration of the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
