APPLICANT REQUESTS THAT:

His current duty title as reflected on  his  Officer  Selection  Brief
(OSB) for the CY03B Colonel Central Selection Board  be  changed  from
“Chief, Operations Division” to “Deputy Commander.”

He be considered for promotion to the  grade  of  colonel  by  special
selection board (SSB) for the CY03B Colonel  Central  Selection  Board
with the corrected record.

APPLICANT CONTENDS THAT:

His duty title was inappropriately changed less than a month,   30 Sep
03, before his promotion selection board, 27 Oct 03.  His  duty  title
shown on his promotion recommendation  form  (PRF)  reflected  “Deputy
Commander” while his OSB reflected “Chief, Operations Division.”

He believes the discrepancy between the duty titles shown on  his  OSB
and PRF was a “significant factor” in his nonselection  for  promotion
to colonel.

In support of his appeal, applicant provides copies of his  referenced
OSB and PRF.

STATEMENT OF FACTS:

The applicant is serving on active duty in  the  grade  of  lieutenant
colonel.  His Total Active Federal Military Service Date (TAFMSD) is 8
Sep 79.  He entered active duty  on  18  Jun  82.   According  to  the
applicant’s OSB he was assigned the duty title of  “Chief,  Operations
Division” effective 1 Jun 02.  The first  officer  performance  report
(OPR) he received with this duty title was for the period 7 Oct 01  to
6 Oct 02.  He received a second OPR  with  this  duty  title  for  the
period 7 Oct 02 to 27 Jun 03.  His OSB indicates he was  assigned  the
duty title of “Deputy Commander” effective 1 Jul 03 and reassigned the
title of “Chief, Operations Division” effective 30 Sep 03.   His  most
recent OPR for the period 28 Jun 03 to 27 Jun 04 reflects a duty title
of “Chief, Operations Division.”  Applicant does  not  have  any  OPRs
with a duty title of “Deputy Commander.”

AIR FORCE EVALUATION:

AFPC/DPAO  recommends  denial  of  the   applicant’s   request.    The
applicant’s OSB appears to be correct and he has provided no  evidence
to support his claim.

Based on AFPC/DPAO’s determination, AFPC/DPPPO finds no basis to grant
the  applicant  promotion  consideration  by  SSB  and,  subsequently,
recommends denial.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant on
14 Jan 05 for review and comment within 30 days.  To date, a  response
has not been received.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinions and  recommendations  of  the  Air
Force offices of primary responsibility and adopt their  rationale  as
the basis for our conclusion that  the  applicant  has  not  been  the
victim of an  error  or  injustice.   Therefore,  in  the  absence  of
evidence to the contrary, we find no  compelling  basis  to  recommend
granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
