APPLICANT REQUESTS THAT:
Her nonselection for promotion to the grade of major by the CY02B
Central Major Selection Board be voided and she be directly promoted
to the grade of major.

APPLICANT CONTENDS THAT:
She was unfairly nonselected for promotion to the grade of major due
to her having a serious illness.
Her illness caused her not to work for several months. When she
received an officer performance report (OPR) covering this period,
there was a lack of accomplishments to document in the OPR. She later
discovered that she should have been assigned to the patient squadron,
where an OPR would not have been required.
After release of the promotion board results, she was initially told
that she had been selected for promotion, only to be told several
hours later that she had not been selected.
She deserves promotion. Applicant provides an overview of her
qualifications for promotion.

STATEMENT OF FACTS:
The applicant is a clinical nurse serving on active duty in the grade
of captain. She has three nonselections to the grade of major by the
CY02B, CY03A, and CY03B, Central Major Promotion Selection Boards. A
review of the applicant’s last eight OPRs reflects overall ratings of
“meets standards” (officers either meet or do not meet standards).

AIR FORCE EVALUATION:
AFPC/DPPPO recommends denial of the applicant’s request. They do not
agree with the applicant’s contentions that she should have been
assigned to a patient squadron, which would have excluded the
requirement for an OPR. AFPC/DPPPO references the requirements for
assignment to a patient squadron as specified in AFI 41-210. They
conclude that the OPR rendered on the applicant during the timeframe
in question was appropriately rendered.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
26 Mar 04 for review and comment within 30 days. To date, a response
has not been received.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt their rationale as the
basis for our conclusion that the applicant has not been the victim of
an error or injustice. Additionally, we note that the applicant has
not provided any support from her rating chain regarding the
appropriateness of the OPR rendered on her closing 5 Jun 02.
Therefore, in the absence of evidence to the contrary, we find no
compelling basis to recommend granting the relief sought in this
application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

Her overseas duty history was not on her OSB when the CY02B lieutenant colonel board met; however, her current duty has since been updated and does reflect completion of the overseas assignment to Turkey. The DPAMF2 evaluation is at Exhibit C. AFPC/DPPPO recommends denial. DPPPO states that completion of training courses are not reflected on OSBs; however, a training report filed in her Officer Selection Record (OSR) documented her attendance and completion of the course in 1991.
