She be offered continuation to serve as a captain in the Air Force
until she is eligible for retirement.

APPLICANT CONTENDS THAT:
Her recent nonselection for continuation by the CY03B Captain
Selective Continuation Board has left her five months short of
sanctuary and ineligible for retirement after completion of almost 18
years of service. Her current projected date of separation (DOS) is
31 August 2004.
In support of her request, applicant’s superior submitted a letter of
recommendation for continuation. The applicant’s complete submission,
with attachment, is at Exhibit A.

STATEMENT OF FACTS:
Information extracted from the Personnel Data System (PDS) reveals the
applicant’s Total Active Federal Military Service Date (TAFMSD) as 9
January 1987. Her Total Active Federal Commissioned Service Date
(TAFCSD) is 22 June 1994. She is currently serving on active duty in
the grade of captain, with an effective date and date of rank of 20
March 1998. The following is a resume of her Officer Performance
Report (OPR) ratings subsequent to her promotion to that grade.

The applicant was considered In-the-Promotion Zone (IPZ) and
nonselected for promotion to the grade of major by the CY03A Major
Central Selection Board, which convened on 5 May 2003.
The applicant was considered Above-the-Promotion Zone (APZ) and
nonselected for promotion to the grade of major by the CY03B Major
Central Selection Board, which convened on 8 December 2003. Due to
her second nonselection for promotion, she was eligible for
continuation. However, she was not offered continuation by the CY03B
Captain Selective Continuation Board.

AIR FORCE EVALUATION:
HQ AFPC/DPPPO, recommends the application be denied. DPPPO stated
that the applicant's Air Force Specialty Code (AFSC) of 64P (Contract
Manager) did not meet the eligibility criteria established for
continuation at the CY03B Captain Selective Continuation Board. The
applicant will have 18 years of total active military service on 9
January 2005. Her mandatory DOS of 31 August 2004 puts her
approximately five months short of sanctuary and ineligible for
retirement. The applicant is not eligible to return to the enlisted
ranks due to a break in service. Although the applicant’s director
supports continuation, her AFSC was not identified as critical to the
needs of the Air Force for retention. If the Board approves the
applicant’s request, DPPPO recommends the applicant’s records be
corrected to show she was offered continuation to 20 years of TAFMS or
until eligible for a normal (20 year) retirement. The HQ AFPC/DPPPO

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant reviewed the advisory opinion and indicated that she is
a fully qualified Acquisition Professional Development Program (APDP)
Level III in contracting certified contracting officer. She was
selected as the Air Force Materiel Command Outstanding Contracting
Officer of the Year 2003, CGO, Systems level. She has dedicated over
half of her life to the Air Force, which includes her enlisted time,
ROTC, an educational delay and commissioned time. She was handpicked
to be a Logistics Group Executive Officer and an Acquisition Manager
at the Air Force Personnel Center. She attended Squadron Officer
School in-residence and has a Master of Business Administration
degree. She has held key positions where she has supervised and led a
flight and squadron. The Evaluation Reports Appeal Board (ERAB)
considered and denied the applicant’s request to have her Officer
Performance Report (OPR), closing 15 June 2002, replaced with a
reaccomplished report. She believes her record does not accurately
reflect all of her achievements.
In support of her request, the applicant submits a copy of her appeal
to the ERAB and the ERAB decision. The applicant’s complete
submission, with attachments, is at Exhibit E.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. The applicant is requesting her
records be corrected in a manner that would enable her to retire.
After thoroughly reviewing the evidence of record and noting the
applicant’s contentions, we believe she was denied fair and equitable
consideration for promotion to the grade of major, her second
nonselection, which established a mandatory date of separation. We
note that the applicant has provided documents supporting the
replacement of her Officer Performance Report (OPR), rendered for the
period 5 July 2001 through 15 June 2002. In our review of the
statements, we note that the rater and additional rater indicated the
cited OPR does not accurately reflect the applicant’s achievements and
that they unintentionally omitted service school and commander
recommendations at the time they rendered the report. Having no basis
to question their integrity, we believe replacing the cited report
with the reaccomplished report provided is warranted.
4. In view of the above determination, and noting that the applicant
is in close proximity of reaching sanctuary, we believe that action
should be taken to allow her to remain on active duty in order for her
to be considered for promotion by the next regularly scheduled major
selection board as an above-the-promotion zone (APZ) eligible, which
would also place her in the sanctuary for retirement. In order to
accomplish this end, one of her nonselections should be set aside.
Accordingly, we recommend the applicant’s records be corrected to the
extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that:
a. The Company Grade Officer Performance Report (OPR), AF Form
707B, rendered for the period 5 July 2001 through 15 June 2002, be
declared void and removed from her records; and, the reaccomplished
OPR, signed by the reviewer on 17 June 2002, be accepted for file in
its place.
b. She was not considered for promotion to the grade of major
by the Calendar Year 2003B Major Central Selection Board.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to APPLICANT be corrected to show that:
a. The Company Grade Officer Performance Report (OPR), AF
Form 707B, rendered for the period 5 July 2001 through 15 June 2002,
be, and hereby is, declared void and removed from her records; and,
the reaccomplished OPR, signed by the reviewer on 17 June 2002, be,
and hereby is, accepted for file in its place.
b. She was not considered for promotion to the grade of
major by the Calendar Year 2003B Major Central Selection Board.
