APPLICANT REQUESTS THAT:

He be awarded the Air Force Overseas Short Tour Ribbon (AFOSTR).

APPLICANT CONTENDS THAT:

He was in Thailand from 1972 to 1973 and believes he  is  entitled  to
the award.

The applicant’s complete submission is at Exhibit A.

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air Force on 9 Jul 71. He had an
overseas tour in Thailand from 10 Feb 72 to 9 Feb 73. He reenlisted on
20 Nov 74 and was honorably discharged in the grade of staff  sergeant
on 19 Nov 78 after 7 years, 4 months and 11 days of active service.

The Air Force Overseas Short/Long Tour  Ribbons  were  established  on
12 Oct 80, after the applicant’s 19 Nov 78 separation.

AIR FORCE EVALUATION:

HQ AFPC/DPPPR advised the applicant on 15 Sep 03 that the  AFOSTR  was
established after his separation and  is  not  awarded  retroactively.
Since he is not eligible for the ribbon, denial is recommended.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the Air  Force  evaluation  was  forwarded  to  the
applicant on 26 Nov 03 for review and comment within 30 days.   As  of
this date, this office has received no response.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After a thorough  review  of  the
evidence  of  record  and  the  applicant’s  submission,  we  are  not
persuaded that he should be awarded the AFOSTR. Although the applicant
had an overseas tour in Thailand, the AFOSTR was not established until
12 Oct 80, after the applicant’s 19 Nov 78 separation.  The  award  is
not retroactive. We therefore agree with the  recommendations  of  the
Air Force and adopt the rationale  expressed  as  the  basis  for  our
decision that the applicant has failed to sustain his burden of having
suffered either an error or an injustice. In view  of  the  above  and
absent persuasive evidence to the  contrary,  we  find  no  compelling
basis to recommend granting the relief sought

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
