APPLICANT REQUESTS THAT:
His DD Form 214 be corrected to reflect award of the Armed Forces
Expeditionary Medal in support of Operation SOUTHERN WATCH and the
Southwest Asia Service Medal.

APPLICANT CONTENDS THAT:
These awards were omitted on his DD Form 214. He would like to have
this corrected for future reference.

STATEMENT OF FACTS:
The applicant’s records reflect he served on active duty from 22
October 1990 through 19 December 1997.
His DD Form 214 reflects he was awarded the Air Force Achievement
Medal, Aerial Achievement Medal with one Oak Leaf Cluster, Air Force
Longevity Service Award Ribbon, Air Force Training Ribbon, National
Defense Service Medal, Humanitarian Service Medal, Air Force
Outstanding Unit Award with one Oak Leaf Cluster, Small Expert
Marksmanship with one Bronze Service Star; Armed Forces Service Medal,
Armed Forces Expeditionary Medal (UPHOLD DEMOCRACY). Additionally the
DD Form 214 does not reflect any Foreign Service.
The applicant’s Enlisted Performance Report (EPR) for the period
closing 28 July 1996 indicates the applicant was chosen to participate
in Static displays at Wright Patterson AFB and Saudia Arabia. The EPR
also indicated he maintained the highest standards of professionalism
while deployed. The EPR closing 4 May 1997 indicates he diagnosed,
troubleshot, and repaired critical electronic intelligence systems
while deployed overseas. Also, the indorser commented that the
applicant helped a flight crew with aircraft servicing while deployed
to a base without RC-135 support. There are no further references
regarding the duration of the aforementioned TDYs.
The applicant was released from active duty on 19 December 1997 with a
honorable discharge for miscellaneous/general reasons.

AIR FORCE EVALUATION:
HQ AFPC/DPAPP2 states there are no documents in the applicant's
records to specify his stop and start dates to the Area of
Responsibility (AOR). AFPC/DPAPP2 on 20 February 2003 requested the
applicant check his personal records and submit any documentation to
verify any TDY to the AOR. The applicant did not provide the
requested information. They recommend denying the requested relief.
A complete copy of the evaluation is attached at Exhibit C.
HQ AFPC/DPPPR states the applicant did not respond to the request to
provide documentation to show he was TDY to the Persian Gulf for 30
consecutive or 60 nonconsecutive days in direct support of Operation
SOUTHERN WATCH. The copy of the certificate provided by the applicant
was locally produced and is not valid. Without a copy of TDY orders
or Travel Vouchers, the applicant’s eligibility for either award
cannot be verified. They recommend the applicant’s request be denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Copies of the Air Force evaluations were forwarded to the applicant on
30 May 2003, for review and response. As of this date, no response
has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinions and the recommendations of the Air
Force and adopt their rationale as the basis for our conclusion that
the applicant has not been the victim of an error or an injustice.
The applicant's records do not reflect that he was TDY to Southwest
Asia for 30 consecutive or 60 nonconsecutive days. The applicant was
requested to provide any documentation to support his claim; however,
as of this date, he has not provided any documentation to verify he
was assigned or TDY in Southwest Asia and therefore his eligibility
for either award cannot be verified. Therefore, in the absence of
evidence to the contrary, we find no compelling basis to recommend
granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
