APPLICANT REQUESTS THAT:
He be considered by a Special Selection Board (SSB) for the CY02A
Major (Line) Central Selection Board, which convened on 19
February 2002, with the Joint Service Commendation Medal (JSCM)
included on his Officer Selection Brief (OSB).

APPLICANT CONTENDS THAT:
While he exercised extreme diligence in making sure his package was
complete prior to the CY02A Major (Line) Central Selection Board,
somehow, his Officer Selection Brief (OSB) was missing a recently
awarded Joint Service Commendation Medal (JSCM). Applicant believes
that had the decoration been included in his OSB he would have been
selected for promotion to major. The exclusion of his JSCM had an
“…enormous negative impact on (his) promotion potential.”

STATEMENT OF FACTS:
Information from the Personnel Data System (PDS) indicates that the
applicant’s Total Active Federal Military Service Date (TAFMSD) is 4
April 1992. He is currently serving in the grade of captain.
A resume of applicant’s Officer Performance Reports (OPR) subsequent
to his promotion to the grade of captain follows:

The applicant was awarded the JCSM for meritorious service during the
period October 1997 to October 2001. Information in the PDS reflects
that the decoration order was issued February 2002. The OSB dated 5
February 2002 does not show the decoration.

AIR FORCE EVALUATION:
HQ AFPC/DPPPOO recommends disapproval of the applicant’s request for
reconsideration for promotion by an SSB. DPPPOO stated that while the
JSCM was not reflected on the applicant’s OSB, the citation was filed
in the Officer Selection Record (OSR). Consequently, DPPPOO stated
that the board was aware of the medal and that the board did factor
the decoration into their overall promotion evaluation.
DPPPOO also states that there was no clear evidence presented by the
applicant that proved the exclusion of the decoration had any negative
impact on the board’s decision. And, that while the OSB had not been
updated to show the award, the citation was on hand for the board to
review.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
27 November 2002 for review and comment within 30 days. As of this
date, there has been no response received by this office. (Exhibit D)

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. Evidence in the record reflects
that the citation for the Joint Commendation Service Medal (JCSM) was
filed in the applicant’s officer selection record (OSR) prior to the
convening of the CY02A Major (Line) Central Selection Board.
Therefore, even though the JSCM was not reflected on his officer
selection brief (OSB), the contents of the citation reflecting the
applicant’s accomplishments were available for consideration by the
selection board members. Other than his own assertions, the applicant
has not presented any evidence showing that the absence of the JSCM on
the OSB caused his records to be so misleading or inaccurate that the
members of the duly constituted selection board, applying the complete
promotion criteria, were precluded from rendering a fair determination
as to his promotion potential. We conclude that there is not a
sufficient basis upon which to recommend favorable action on the
applicant’s request.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
