APPLICANT REQUESTS THAT:
He be considered for promotion to lieutenant colonel by special
selection board (SSB) for the CY01B (5 Nov 01) Central Lieutenant
Colonel Selection Board and permitted to write a letter to the Board
president addressing information not available to his primary board.

APPLICANT CONTENDS THAT:
Due to timing of the Logistics Squadron Commander’s Board, the
events of 11 Sep 01, and erroneous advice from his commander, the
CY01B lieutenant colonel selection board was not aware that he was
on the Logistics Squadron Commander’s list. His commander advice
was to not send a letter to the board until he had been hired as a
commander. He was notified of his selection as a squadron commander
on 4 Dec 01. Had his selection as a commander and the release of
the list been timely, he would have been able to send a letter to
the board stating that he had been selected as a commander. He
believes that because the board did not know of his selection to
command, he did not receive full consideration for promotion to
lieutenant colonel. In support of his appeal, applicant submits a
letter of support from his former commander.

STATEMENT OF FACTS:
The applicant is presently serving on active duty in the grade of
major. His Total Active Federal Military Service Date (TAFMSD) 14
Oct 86. A review of the applicant’s last ten Officer Performance
Reports (OPRs) indicates overall ratings of “meets standards.” The
applicant was considered and nonselected for promotion to lieutenant
colonel by the CY01B Central Lieutenant Colonel Selection Board.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends denial of the applicant’s request. Although
an explanation of the applicant’s selection as a squadron commander
was not present in his officer selection record, the selection board
had his entire officer selection record during promotion
consideration. They are not convinced that the absence of the
letter to the board explaining his squadron commander candidacy
caused his promotion nonselection.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
21 Jun 02 for review and comment within 30 days. To date, a
response has not been received.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After reviewing the complete
evidence of record, we were not persuaded that the applicant’s
promotion opportunity was negatively impacted by the promotion
selection board not being aware of his selection as a candidate for
squadron commander. Notwithstanding the timing of his board and the
advice given by his commander, the applicant was considered for
promotion based on his complete record of performance. It was the
applicant’s decision whether or not to write a letter to the promotion
board. He sought the advice of his commander and then decided not to
submit a letter. Therefore, in the absence of evidence to the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice;
that the application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.

In support of his request, applicant provided his MSM citation and special order GB-18. DPPPO states that although the period of award for the decoration was through 17 Jul 01, the orders for the decoration were not published until 9 Nov 01. Thus, it is our opinion that the MSM was not a matter of record at the time the selection board convened and accordingly, it was not required to be included in his selection record.
In support of his request, applicant provided his MSM citation and special order GB-18.
