APPLICANT REQUESTS THAT:

He be given Special Selection Board (SSB) consideration for  promotion
to the grade of lieutenant colonel by the Calendar Year 2001B  (CY01B)
Lieutenant Colonel Board, which convened on 5 Nov 01,  with  inclusion
of the Meritorious  Service  Medal  (MSM),  Second  Oak  Leaf  Cluster
(2OLC), in his Officer Selection Record (OSR).

APPLICANT CONTENDS THAT:

After reviewing his career brief, he discovered that his end  of  tour
MSM was not in his records when the CY01B  selection  board  convened.
The period of the decoration was from 4 Jun  98  to  28 Sep  01.   The
decoration package was processed and approved on 12 Oct  01.   He  was
reassigned effective 1 Oct 01.

In  support  of  his  appeal,  the  applicant  provided  documentation
pertaining to the MSM (2OLC) and a copy of his career brief.

Applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Information extracted from the Personnel Data System  (PDS)  indicates
that the applicant is currently serving on active duty in the grade of
major, having been promoted to that grade  on  1 Nov  95.   His  Total
Active Federal Military Service Date (TAFMSD) is 10 Jan 84.

Applicant's  Officer  Performance  Report  (OPR)  profile  since  1991

AIR FORCE EVALUATION:

AFPC/DPPPO recommended denial.  AFPC/DPPPO noted  the  period  of  the
decoration was through 28 Sep 01.  According to  AFPC/DPPPO,  AFI  36-
2803, Table 3.1, Note 5,  directs  forwarding  citations  and  special
orders within 30 days of the date the special  orders  are  published.
As such, the special order and citation for award of  the  MSM  (2OLC)
were processed within the guidelines of the  governing  directive  and
neither were due for file until 12 Nov 01.  Therefore, the  decoration
did not exist at the time  the  CY01B  board  convened  and  does  not
warrant SSB consideration.

In addition, AFPC/DPPPO indicated that  central  boards  evaluate  the
entire OSR  (including  the  promotion  recommendation  form,  officer
performance reports, officer effectiveness reports, training  reports,
letters of evaluation,  decorations,  and  officer  selection  brief),
assessing whole person factors such as job  performance,  professional
qualities, depth and breadth of experience, leadership,  and  academic
and professional military education.  Although the  citation  was  not
present in his OSR for the board’s review, the selection board had his
entire officer selection record at  their  disposal  during  promotion
consideration.  In fact, the majority of the accomplishments mentioned
on the MSM (2OLC) citation was also reflected on the applicant’s OPRs.
 Accordingly, they are not convinced the missing  decoration  citation
contributed to the applicant’s promotion nonselection.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to  applicant  on  17
May 02 for review and response.  As of this date, no response has been
received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the  existence  of  error  or  injustice.   The  applicant's  complete
submission was thoroughly  reviewed  and  his  contentions  were  duly
noted.  However, we do not find the  applicant’s  assertions  and  the
documentation  presented  in  support  of  his   appeal   sufficiently
persuasive to override the rationale provided by the Air Force  office
of primary responsibility (OPR).  We note that the MSM (2OLC) was  not
required to be filed in the applicant’s records when he was considered
for promotion by the CY01B Lieutenant Colonel Board.  Furthermore,  we
find no evidence  that  there  was  any  attempt  by  the  applicant’s
superiors to ensure the decoration’s inclusion in his OSR prior to the
convening of the CY01B board.  In view of the foregoing,  and  in  the
absence of sufficient evidence to the contrary, we adopt the Air Force
rationale and conclude that no basis exists to recommend granting  the
relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon the
submission of newly discovered relevant evidence not  considered  with
this application.
