APPLICANT REQUESTS THAT:

He be credited with an extra point to reflect a satisfactory  year  of
Federal service for the  retirement/retention  (R/R)  year  ending  29
April 1998.

APPLICANT CONTENDS THAT:

A paperwork error regarding his transfer  to  the  Reserve  Individual
Mobilization Augmentee (IMA) program caused him to have the bad  year.
A timing constraint prevented him from performing  a  30-day  tour  of
duty until after the end of his R/R year.  He was never told about R/R
requirements and that he believed a  good  year  centered  around  the
fiscal year, as he stated was always the situation in the Air National
Guard (ANG).

The applicant did not submit any  supporting  documentation  with  his
application.

STATEMENT OF FACTS:

On 30 Apr 83, the applicant was appointed a second lieutenant, Reserve
of the Air Force, and was voluntarily ordered to extended active  duty
on 14 May 83.  On 1 Dec 89, he was released from active  duty  in  the
grade  of  captain  and  transferred  to  the   Air   Force   Reserve,
Nonaffiliated Nonparticipating Ready Personnel  Section  (NNRPS),  and
remained there until he was appointed a  captain  in  the  Nevada  Air
National  Guard  (ANG),  effective  4  Dec  89.   The  applicant   was
progressively promoted to the grade of major, with a date of  rank  of
30 Apr 97.  On 17 Feb 98, he was honorably discharged from the  Nevada
ANG in the grade of major and transferred to the Air Force Reserve IMA
program, effective 18 Feb 98.

Information  extracted  from  the  applicant’s  Point  Credit  Summary
indicates that he was credited  with  satisfactory  years  of  Federal
service for the R/R years 30 Apr 83 to 29 Apr 97.  From 30 Apr  97  to
29 Apr 98 he was credited with a total of 49 points, which is 1  point
short of a satisfactory year.  Subsequent to this time, the  applicant
has earned sufficient points to be credited with a  satisfactory  year
of Federal service for the R/R year 30 Apr 98 to 29 Apr 99.  As of  29
Apr 99, the applicant has accumulated a total of 15 satisfactory years
of Federal service.

The relevant facts pertaining to this application are contained in the
letter  prepared  by  the  appropriate  office  of  the   Air   Force.
Accordingly, there is no need to recite these facts in this Record  of
Proceedings.

AIR FORCE EVALUATION:

The Director of Personnel Program Management, HQ ARPC/DP, stated  that
for the R/R year 30 Apr 97 to 29 Apr 98, the applicant earned 0 active
duty (AD) points, 34 Inactive Duty Training (IDT) points, 0  Extension
Course Institute (ECI) points, 15  membership  points,  49  total  and
retirement points, and an unsatisfactory year of Federal service.  For
an R/R year to be satisfactory, a Reservist must earn a minimum of  50
points.  The 34 IDT points were for paid IDT periods  performed  prior
to the applicant’s transfer to the IMA  program.   The  applicant  was
transferred to a participating status as an IMA and  was  eligible  to
participate for points from 18 Feb 98 until the end of his R/R year on
29 Apr 98.

DP indicated that in accordance with the governing Air Force manual, a
year of satisfactory Federal service for retirement is awarded when  a
member earns a minimum of 50 points in their full R/R  year.   It  has
never been the Air Force Reserve or ANG policy to  award  satisfactory
Federal service based on the fiscal year.

DP recommended the application be disapproved.  The applicant did  not
provide documentation to support his claim of a paperwork error.   His
master personnel record does not show any changes to  the  applicant’s
original orders, nor does it show the orders were late in transferring
him from the ANG to IMA program (Exhibit C).

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to  applicant  on  10
May 1999 for review and response.  As of this date,  no  response  has
been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice.  After a careful  review  of
the   evidence   of   record,   we   note   that,   except   for   the
retirement/retention period in  question,  the  applicant  had  earned
sufficient points to be credited with 15 satisfactory years of Federal
service.  In our opinion, the evidence indicates  that  the  applicant
was diligent in maintaining his point credit  and  that  circumstances
beyond his control prevented him from completing a  satisfactory  year
of service during his transition from the Air National  Guard  to  the
Air Force Reserve Individual Mobilization Augmentee program.  In  view
of the circumstances of the case, we conclude that any doubt should be
resolved in the applicant’s favor and that his record be corrected  as
indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT be corrected to show that he was  credited  with
an additional 1  nonpaid  inactive  duty  training  point  during  the
retirement/retention year 30 April 1997 to 29 April 1998, resulting in
50 total points; and, that the period 30 April 1997 to 29  April  1998
is a year of satisfactory Federal service for retirement.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating to APPLICANT be corrected to show that he was credited
with an additional 1 nonpaid inactive duty training point during the
retirement/retention year 30 April 1997 to 29 April 1998, resulting in
50 total points; and, that the period 30 April 1997 to 29 April 1998
is a year of satisfactory Federal service for retirement.
