APPLICANT REQUESTS THAT:
Retention/Retirement (R/R) year 8 Mar 99 to 7 Mar 00 be awarded enough
nonpaid points to make it a satisfactory year of federal service for
retirement.

APPLICANT CONTENDS THAT:
He joined the Reserves on 18 Nov 98, immediately after separating from
active duty. His Reserve recruiter told him his R/R date would be 18
Nov-18 Nov. He performed 38 inactive duty training (IDT) periods from
Nov 98-Mar 99 as well as a two-week tour. In Apr 99, he received
notice that his R/R date had been adjusted to 8 Mar-7 Mar. In Jun-Jul
99, he checked his point status and was repeatedly told he had enough
points [for a satisfactory year]. However, he found out later this had
been incorrectly based on fiscal, rather than R/R, year requirements.
In Aug 99, he was told he needed 10 more points (5 days) to have a
good year, which he performed in Sep 99. In May 00, he received a
point summary showing Mar 99-Mar 00 did not have enough points for a
good year.

STATEMENT OF FACTS:
The applicant entered the delayed enlistment program (DEP) on 21 May
87 and was assigned to the regular Air Force on 8 Mar 88. The time
spent in the DEP is not creditable for service toward retirement.
Upon separation from the Regular Air Force, he enlisted in the
Reserves on 18 Nov 98, and his R/R date was originally established as
18 Nov. However, an R/R date should be established upon initial entry
into uniformed service which, in this case, should have been 8 Mar.
In Apr 99, the applicant’s service history was audited and, as a
result, his R/R date was changed to 8 Mar. He was advised of this
change on 3 Apr 99. As a consequence, his earned points were realigned
to coincide with the 8 Mar R/R date. He did not participate for
points from 17 Feb-9 Sep 99. According to HQ ARPC/DPP, he has 43
points for R/R Mar 99-Mar 00; 50 points are needed for a satisfactory
year.

AIR FORCE EVALUATION:
The Deputy Director, HQ ARPC/DPP, reviewed the appeal and provided his
rationale for recommending denial. The letter informing the applicant
of his R/R date change referred him to the ARPC homepage and informed
him of an item of special interest to all Individual Mobilization
Augmentee (IMA): the R/R-Fiscal Year (F/Y) analyzer. This analyzer
was designed to help IMAs calculate where the points they earn will
fall in their current R/R and fiscal years. The applicant did
complete the F/Y 99 requirement of 12 active duty (AD) points and 48
IDT by participating for 10 points during Sep 99; however, these
points were actually the first points earned for his 8 Mar-7 Mar 00
R/R year.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant asks why would he continue to perform training days when
he had, as of Feb 99, more than enough points for what was [emphasis
applicant’s] his R/R year at that time? Before his R/R date was ever
changed, he had completed all training day and active duty
requirements, based on the information he had at the time, by Feb 99.
He called ARPC in Jun-Jul 99 to verify his status because he was new
to the program and wanted to be sure he had met requirements, not
because the R/R date change issue had surfaced. In Aug 99 he was told
he needed 10 more points for a good year and not that he really needed
17 points. He earned the 10 points when he finally learned he needed
them--why would he have not earned the additional 7? Had he known, he
had enough time to earn them. Further, very little correspondence
from HQ ARPC reached him because his unit of assignment did not
forward it. Finally, tools like the R/R-F/Y analyzer are helpful
after an IMA understands the system and an IMA in a small unit like
his is “on his own” most of the time. How would he know there was an
office for F/Y points and another for R/R points when the ARPC phone
directory only lists “Points Branch” and no one told him about the
separate offices?

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice to warrant awarding 7
additional points for a satisfactory year of federal service. In this
regard, the applicant appears to have acted in good faith and
fulfilled his R/R point requirements to the best of his knowledge and
ability. The confusion resulting over the changed R/R date, his
inexperience in the Reserve program, and the apparently confusing and
inaccurate information he received support rectifying this error.
Therefore, to offset any possibility of an injustice, we recommend the
applicant’s records be corrected to show that he earned 7 additional
points in his R/R year ending 7 Mar 00 and that it was, in fact, a
satisfactory year of federal service.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that he was credited with
an additional seven (7) nonpaid inactive duty training points during
the retirement/retention year 8 March 1999 to 7 March 2000, resulting
in 50 total points; and that the period 8 March 1999 to 7 March 2000
is a year of satisfactory Federal Service for retirement.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to XXXXXXX, be corrected to show that he was credited
with an additional seven (7) nonpaid inactive duty training points
during the retirement/retention year 8 March 1999 to 7 March 2000,
resulting in 50 total points; and that the period 8 March 1999 to
