MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR
Having carefully reviewed this application, we agree with the
recommendation of the Air Force office of primary responsibility
and adopt the rationale expressed as the basis for our decision
that the applicant has,been the victim of either an error or an
injustice. Therefore, under the authority delegated in AFI
36- 2603, the applicant's records will be corrected as set forth in
the accompanying Memorandum for the Chief of Staff signed by the
Executive Director of the Board or his designee.

Requested Action. Applicant requests change in captain date of rank and nullify the
nonselection for promotion by the CY98 Major Line (LM) Central Selection Board.
Discussion. HQ AFPCAIPPADR, Service Verification, memorandum 23 Jul98, supports
applicant’s request based on provisions at the time of the applicant’s acceptance to the Recall
Program and the subsequent implementation of DoD Directive 13 10.1, Rank and Seniority of
Commissioned Oficers.
Recommendation. Approval.
Summary. Recommend Board approve applicant’s request to change his date of rank of
captain fiom 11 Feb 91 to 23 Oct 92. Recommend Board declare void the applicant’s
nonselection for promotion to major fiom the CY98 Major Line of the Air Force Central
Selection Board.

The attached application for Correction of Military Record is forwarded for
appropriate action, since corrective action cannot be accomplished at this
level.
.
The facts surrounding Captain
request are substantially the
same as other requests that we recommended for approval. All requests stem
from the implementation of DoD Directive 1310.1 on 1 Oct 96. The officers
expressed concern for retaining the date of rank they held in their reserve
units when they were notified of their selection for recall by the FY97
Voluntary Navigator/Electronic Warfare Officer (NAF/EWO) Recall Program.
Some corrections have been approved by the AFBCMR, other cases are
pending review.
Captain
was a reserve officer in an active reserve unit. He
applied, and was accepted, for extended active duty by the FY97 NAVIEWO
Recall Program. When he was notified of his selection, he expressed concern
about retaining the date of rank he held in the reserves, 11 Feb 91. He was
advised that in accordance with AFI 36-2604, Service Dates and Dates of
Rank, his date of rank would have to be readjusted by backdating his
extended active duty date by one day for each day of active commissioned
service and one-half day for each day of reserve commissioned service. As a
result he would enter active duty in the grade of captain with a n active duty
date of rank of 23 Oct 92. With this date of rank, using projected promotion
board schedule, Captain -would
be in-the-promotion-zone (IPZ)
for major in CY1999. He had this information when he accepted the recall
offer.
Upon implementation of DOD Directive 1310.1, Rank and Seniority of
Commissioned Officers, effective 1 Oct 96, all reserve officers on the Reserve
Active Status List in transition from the reserves to active duty, would retain
the date of rank they held in their reserve unit. Therefore, we changed
date of rank from 23 Oct 92 to 11 Feb 91, the same

date of rank he-held in the reserves (Atch 1). This means he is was IPZto
major in CY 1998 which is earlier than he had understood when he accepted
recall.
Captain
claims that this change will force him to compete for
promotion with active duty officers who have had professional development
opportunities he has not had as a member of the reserves. He also states
that retaining his original date of rank will make it almost impossible for
him to catch up with his act’ive duty counterparts and he will not have to
opportunity to establish a competitive military record. This may have
detrimental effect on his future Air Force career.
We understand his concerns, and feel he should be allowed to maintain
the 23 Oct 92 date of rank. Captain

This Directive:
1. Reissues reference (a).
2. Implements Sections 541,620, 641,741,2106, and 2107 of reference (b) to establish
policies goventing the determination of [he dates of rank and precedence of commissioned offi-
cers on the Active Duty List.

policies governing the determination of the dates of rank and precedence of commissioned offi-
cers on the Reserve Active Status List.
€3. APPLICABILITY
This Directive applies to the Office of the Secretary of Defense and the Military Depart-
ments.
C. pEFI’NTTION’
1. Active Dutv List. A single list for the Army, the Navy, the Air Force, or the Marine Corps
that is required to he maintained under Section 620 of reference (b) and that contains the names
of all officers of that M.11it.q Service other than officers described in Section 641 of reference
(b) who are serving on active duty.

2. Commissioned officer. Ari officer in any of the Military Services who holds a grade and
office under a conmission signed by the President, and who is appointed as a Regular or Reserve
officer. It does not include a commissioned warrant officer or a retired commissioned officer.
3. Reserve Active SWUS List. A single list for the my, the Navy, the Air Force, or the
Marine'Corps. required to be maintained under Section 14002 of 10 U.S.C. (reference (b)),
which contains the names of all officers of that Armed Force, except warrant officers (including
commissioned warrant officers) who are in an active stahls in a Reserve component of the Army,
the Navy, the Air Force, or the Marine Corps and are not on an Active Duty List.
4. Service AqaJemks. United States Military Academy, United States Naval Academy, and
United States Air Force Academy.
D. POLICY
1. General. 11 is the policy of the Department of Defense to ensure, to the maximum extent
practicable. that the relative seniority of commissioned officers who are placed on the Active
Duty List or R~serve Active Status List is determincd uniformly and equitably among the Mili-

2. Commissioried OFficer Grades. Among the grades listed below, the grades of general and
admiral are equivalent and are senior to other grades; the grades of second lieutenant and ensign
are equivalent and are junior to other grades.

equivalent grades is determined by comparing dates of rank. An officer whose date of rank is
earlier than the date of rank of another officer of the samc or equivalent grade is senior to that
officer, except for the Chairman and the Vice Chairman, Joint Chiefs of Staff, who respectively
ouvank all other officers of the Armed Forces.

quired for the officer's appoinrrnenr grade under DoD Directives 1320.7, 13 12.2, t% 1312.3
(reference (c), (d). or (e)).
5. Date of Rank for Officers in Transition to and from the Reserve Act ive Status List and
Active Duty List. A Reserve component officer ordered to active duty and placed on the Active
Duty List in the Army, Navy, Air Force, or Marine Corps maintains his or her rank and date of
rank under Section 741(dj(3) of 10 U.S.C. (rcferencc (b)).
a. Effect of Placement'on Active Duty List. An officer on the Reserve Active Status List
and on a promotion list as a result of selection for promotion by a mandatory promotion board or
a special selection board and. who before being promoted is placed on the Active Duty List of
the same Armed Force and placed in the same competitive category, shall be placed on an appro-
priate promotion list for officers on thc Active Duty List under Scction 143/7(b) of reference (b).
The effective date of promotion and date of rank shaIl be the same as if the officer had been se-
lected to the gradc concerned by the promotion board for Active Duty List officers.

b. Qfficers on a Promotion List Removed from the Active Duty List. An officer on the
Active Duty List and 6n I promotion list as a result of selection for promotion and who before
being promoted is removed from the Active Duty List and placed on thc Reserve Active Status
List of the same Armed Force and in the same competitive category (including a Regular officer
who on removal from the Active Duty List is appointed as a Reserve officer and placed on the
Reserve Active Status Lis[) shall be placed on an appropriate promotion list pursuant to Section
I4317(c) of reference (b). The effective date of promotion and date of rank shall be the same as
if the officer had been selected to the grade concerned by the promotion board for Reserve Ac-
tive Status List officers. If the Secretary of the Military Department concerned determines cir-
cumstances exist such that an inequity would result in following the foregoing method in deter-
mining date'of rank, he or she may set the date of rank,

the date that the class of cadets or midshipmen was graduated from the United States Militvy
Academy, the United States Naval Academy, or the United States Air For= Academy, as the
case may be, in that year. Such appointees who enter active duty before the graduation date of
the appropriate Service Academy may take precedence over academy graduates. Within such
groups of Section 2 106 or 2 107 of reference (b) appointees, distinguished military graduates may
take precedence. In these cases, ticbreaken described in subsection D.7.. below. apply.

Daw 0 f Rank. Graduates of Service Acade-
mies shall be placed initially on the Active Duty List of their Military Service in order of their
class standing at the Service Academy from which graduated. As an exception, academy gradu-
ates appointed in another Military Service under Section 54 1 of reference (b) shall be placed on
the Active Duty List of the gaining Military Service by integrating their class standing into the
class standings of the graduates of the academy of the gaining Military Service. All other of%-
cers who have the same or equivalent,grades and the same date of rank shall rank in order of
seniority based on the following criteria:
a. Previous grade’s date of rank or. if the same, the date of rank in an earlier grade.
b. Previous active duty grade relative seniority (if applicable).

c. Total active commissioned service.
d. Total Federal commissioned service or date of appointment as a commissioned officer.
e. Further differentiation as established by the Secretary of the Milimy Department con-
cerned.

When recalled to Active Duty on the EAD program, I was told I would carry my Reserve date of rank with me onto Active Duty.
Eight months after returning to Active Duty, I was notified my DOR was realigned to the previous Active Duty date I had prior tc
separating from Active Duty in 1992. This realigned date placed me in a year group primary for Major promotion earlier than
agreed upon with my return to Extended Active Dum. The new date forced me to meet mv Drimarv Maiors selection board with
ohy 17 month on Active Duty; an unacceptable situation I would NOT have returned to Active DUG to encounter.
