Applicant  requests that his date of  rank to captain be  changed 
from 30 October 1997 to 24 August  1997.  Applicant's submission 
is at Exhibit A .  
The appropriate  Air Force office evaluated applicant's request 
and provided  an advisory opinion to  the Board  recommending the 
application  be  denied  (Exhibit C). 
The  advisory  opinion was 
forwarded to the applicant for review and response  (Exhibit D). 
As of this date, no response has been received by this office. 

After  careful  consideration  of  applicant's  request  and  the 
available evidence of  record, we  find  insufficient evidence of 
error or injustice to warrant corrective action.  The facts and 
opinions stated in the advisory opinion appear to be based on the 
evidence  of  record  and  have  not  been  rebutted  by  applicant. 
Absent persuasive evidence applicant was denied rights to which 
entitled,  appropriate  regulations  were  not  followed,  or 
appropriate  standards  were  not  applied,  we  find  no  basis  to 
disturb the existing record. 
Accordingly, applicant's request is denied. 
The Board staff is directed to inform applicant of this decision. 
Applicant should also be informed that this decision is final and 
will only be reconsidered upon the presentation of  new relevant 
evidence  which  was  not  reasonably  available  at  the  time  the 
application was filed.

MEMORANDUM FOR AFBCMR

Reauested action:  Applicant is requesting his date of rank to the grade of captain be 

corrected to reflect his 2-year anniversary of 24 Aug 97. 

Basis for request:  Applicant contends he missed the BSC captain board by one day and 
therefore, did not meet a board until after his 2-year anniversary date of rank.  Applicant also 
contends he met a captain board above-the-promotion zone (APZ) on 22 Sep 97 and the SecAF 
changed his date of rank to 30 Oct 97. 

Recommendation:  Denial. 

Facts and Comments: 

a.  Application is timely. 

b.  Applicant entered active duty as a first lieutenant on 19 Mar 97.  Based on 

constructive credit received, his date of rank was established as 24 Aug 95.  The CY97B Captain 
(MSCBSUNC) Central Selection Board convened at HQ AFPC on 19 Mar 97.  To be eligible to 
meet this board, applicant must have had an EAD of  18 Mar 97 or earlier. 

c.  Applicant was selected for promotion to captain in-the-promotion zone (IPZ) 

by the CY97D Central Captain Selection Board which convened at HQ AFPC on 22 Sep 97.  The 
results of the board were approved by the Assistant Secretary of Defense (Force Management 
Policy) (ASD/FMP) on 30 Oct 97. 

d.  In accordance with AFI 36-2501, Officer Promotions and Selective 

Continuation, promote first lieutenants on the active duty list, selected for promotion to captain 
after completing 24-months time-in-grade computed from their date of rank as a first lieutenant, 
or upon ASDFMP approval of the captain selection report, whichever is later.  There are no 
provisions in law to allow the applicant to be promoted to captain with an earlier date of rank.

Summarv: The applicant’s date of rank to captain is correct.  It would not be in the best 
interest of the Air Force to give the applicant a date of rank to capthn that is earlier than that of 
other officers promoted from the CY97B Central Captain Promotion Board.  Application should 
be denied.  We have no recommendation if the Board’s decision is to grant relief over our
