MEMORANDUM FOR THE CHIEF OF STAFF
Under the authority of Section 1552, Title 10, United States
Code and Air Force Instruction 36-2603, and having assured
compliance with the provisions of the above regulation, the
decision of the Air Force Board for Correction of Military Records
is announced, and it is directed that:

MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR
SUBJECT :
Having carefully reviewed this application, we agree with the
recommendation of the Air Force office of primary responsibility
and adopt the rationale expressed as the basis for our decision
that the applicant has been the victim of either an error or an
injustice.

the accompanying Memorandum for the Chief of Staff signed by the
Executive Director of the Board or his designee.

Reauested Action. Applicant requests promotion to major with subsequent date of rank.
Basis for Request. Applicant contends he was on the Army’s promotion list to major
with a date of rank to captain of 11 Jun 99.
Discussion.
a. Application is timely, as applicant entered active duty in the Air Force on 12
Jul98. Applicant was transferred to the Air Force as a captain in the Medical Corps with a date
of rank of 12 Jul98. As of the date of this application, applicant’s service dates have not been
verified and therefore, his date of rank may be adjusted.
b. Applicant was recommended for promotion to major from the FY98 Major
Army Medical Corps and Dental Corps Promotion Board which convened on 10 Feb 98. Per US
TAPC memorandum, 3 1 Jul98, had applicant remained in the Army, his promotion sequence
number 153 would have been promoted on 11 Jun 99.
c. Upon his accession into the active duty Air Force, his selection for promotion
was not transferred or accepted. DoD Directive 1300.4,2 Apr 84, E10, states, “If a
commissioned officer transferred between two of the Military Services is on a promotion list to
the next higher grade under section of reference (b) (USC, Title lo), the Secretary of the Military
Department concerned may integrate the officer into the promotion list of the gaining Military
Service based on the officer’s date of rank in his or her current grade in the losing Military
Service.” Procedures to allow for the transfer of an officer’s promotion selection are not
currently covered in existing Air Force Instructions.
d. Applicant has provided sufficient evidence of his selection for promotion to
major.

Recommendation. Approval. AFBCMR, under the authority of the Secretary of the Air
Force, direct the transfer of the applicant’s promotion to the grade of major from the Army to the
Air Force. AFBCMR direct the applicant’s promotion effective date to major be established as
